whereas the border clashes started after a Cambodian court sentenced two Thai nationals to up to eight years’ imprisonment, having found them guilty of espionage and illegal entry after they crossed into the disputed border area in December 2010, and whereas the sentence immediately followed the successful conclusion of the seventh meeting of the Joint Commission for Bilateral Cooperation between Thailand and Cambodia (JC), on 3-4 February 2011, at which both countries had agreed to extend cooperation in all areas and to hold a meeting of the Joint Commission on Demarcation for the Land Boundary (JBC) in Thailand in the near future,
considérant que ces affrontements frontaliers ont commencé après qu'un tribunal cambodgien a condamné, en décembre dernier, deux ressortissants thaïlandais à huit ans de prison pour espionnage et entrée illégale dans la zone disputée, au lendemain de l'heureuse conclusion de la 7e réunion de la commission mixte de coopération bilatérale entre la Thaïlande et le Cambodge, les 3 et 4 février 2011, au cours de laquelle les deux pays ont convenu de développer leur coopération dans tous les domaines et de tenir prochainement en Thaïlande une réunion de la Commission mixte sur la démarcation de la frontière terrestre,

- (FI) Mr President, the decision of the Cambodian court to sentence opposition leader Sam Rainsy to 10 years in prison in charges relating to the spread of disinformation and falsification of official documents, and other cases like it have led to justified concern in the West regarding the impartiality and independence of the country’s legal system.
– (FI) Monsieur le Président, la condamnation prononcée par le tribunal cambodgien à l’encontre du chef de l’opposition, Sam Rainsy, à 10 ans de prison pour désinformation et falsification de documents officiels et d’autres affaires similaires suscitent, à raison, des doutes en Occident sur l’impartialité et l’indépendance du système judiciaire de ce pays.

whereas on 23 September 2010 the opposition leader Sam Rainsy was sentenced in absentia to 10 years in prison on charges of disinformation and falsifying public documents by the Phnom Penh Municipal Court; whereas his conviction was based on an act of civil disobedience involving the uprooting of six wooden temporary border posts at the Vietnamese-Cambodian border, which is still disputed between the two countries; whereas the action took place in support of villagers who claimed to be victims of land-grabbing, saying that the Vietnamese had illegally shifted the posts onto Cambodian soil, in their rice fields, and that their complaints to the local authorities had remained unanswered,
