The notwithstanding clause of the Canadian Charter of Rights and Freedoms has been used, if I remember correctly—I'll have to check my information, but I did the checks last year—only twice in Canadian history: once after the Constitution was repatriated for a political act of protest against the adoption of the Constitution without Quebec's consent, and a second time in a labour law case in a Prairie province; ultimately, that use was not necessary because the Supreme Court recognized in a similar case a few years later that that act did not violate the right to which the notwithstanding clause had been applied.
