Any person who makes payments or hands over succession property to a person indicated in the Certificate as being entitled to accept such payment or property as heir or legatee should be granted appropriate protection if he acted in good faith relying on the accuracy of the information certified in the Certificate.

To enable them to do so this Regulation should provide for the creation of a uniform certificate, the European Certificate of Succession (hereinafter referred to as "the Certificate") to be issued for use in another Member State.

4. Where a person mentioned in the Certificate as authorised to dispose of succession property disposes of such property in favour of another person, that other person shall, if acting on the basis of the information certified in the Certificate, be considered to have transacted with a person with the authority to dispose of the property concerned, unless he knows that the contents of the Certificate are not accurate or is unaware of such inaccuracy due to gross negligence.
4. The same protection should be granted to any person who, relying on the accuracy of the information certified in the Certificate, buys or receives succession property from a person indicated in the Certificate as being entitled to dispose of such property.
La même protection devrait être accordée à toute personne qui, en se fiant à l'exactitude des informations certifiées dans le certificat, achète ou reçoit un bien successoral d'une personne indiquée dans le certificat comme étant en droit de disposer de ce bien.

The following shall be treated in the same way as a diploma, within the meaning of the first subparagraph: any diploma, certificate or other qualification or any set of diplomas, certificates or other evidence of formal qualifications or any set of such diplomas, certificates or other evidence awarded by a competent authority in a Member State, if it is awarded on the successful completion of education and training received in the Community and recognised by a competent authority in a Member State as being of an equivalent level and if it confers the same rights in respect of the taking up and pursuit of a regulated intellectual profession in that Member State;
