23. Calls on the Commission to proceed immediately with an evaluation of the national implementing measures in respect of Council Framework Decision 2004/68/JHA of22 December 2003 on combating the sexual exploitation of children and child pornography with a view to a proposal for the immediate amendment of national provisions which are contrary to that Decision, and the ratification by all Member States of the Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography adopted by the UN General Assembly on 25 May 2000; considers that one of the Commission's basic priorities should be to strengthen cross-border operations against child pornography internet sites and to improve cooperation between public authorities and private sector bodies with a view to a commitment to close down illegal websites;

Calls on the Member States to consider gender-neutral legislation when it comes to sexual violence and to consider that buying sex from a child (i.e. a minor) should be criminalised in accordance with Article 1 of the Optional Protocol to the UN Convention of the Rights of the Child on the Sale of Children, Child Prostitution and Child Pornography adopted by the UN General Assembly on 25 May 2000; stresses that public awareness is crucial in order to combat and reduce demand for child prostitution and child pornography;

Concerning child pornography, the requirement concerning criminalization of production of pornographic materials involving children is generally met, although it is not possible to provide a precise assessment of the range of exemption from criminal liability concerning child pornography involving children between the age of sexual consent and 18 years.
