Unless otherwise provided in this Directive or in the national law to which the contracting authority is subject, in particular legislation concerning access to information, and without prejudice to the obligations relating to the advertising of awarded concession contracts and to the information to candidates and tenderers set out in Articles 32 and 40, the contracting authority or contracting entity shall not disclose information forwarded to it by economic operators which they have designated as confidential, including but not limited to, technical or trade secrets and the confidential aspects of tenders.

The activities of the Funds and the operations which they help to finance should be consistent with the other Community policies and comply with Community legislation.

5. Regarding the possibility of capitalising on the experiments termed ELCO (enseignement des langues et cultures d’origine – teaching and study of native languages and cultures), which have been doing a great deal to preserve cultural reference points enabling immigrant children to define their identity, the experiments have been beset by huge difficulties either because the necessary backing has not been forthcoming or the bilateral agreements governing them do not always operate as they should or else because the teaching is provided over and above the standard school curriculum (which in itself is very often too much for the youngest pupils), namely at the end of the day or on Saturdays, thus reducing free time and in some cases causing resentment among the pupils, who view these extra lessons as another burden to be shouldered because they are ‘different’ from their schoolmates and consequently prefer to be ‘the same’ and hence ignore the native language and culture of their parents or grandparents.

L'analyse des expériences dénommées ELCO - Enseignement de la langue et de la culture d'origine -, qui ont joué un rôle important pour éviter la perte des références culturelles et identitaires des jeunes et des enfants d'immigrés, a mis en exergue les difficultés énormes qui ont accompagné ces expériences, tant en raison du manque d'aides ou de la dépendance vis-à-vis d'accords bilatéraux qui n'ont jamais fonctionné de façon adéquate que parce que cet enseignement vient s'ajouter à la charge scolaire normale (qui s'avère souvent déjà très lourde pour les élèves les plus nouveaux), avec des cours dispensés en fin de journée ou le samedi, ce qui entraîne une réduction du temps libre et parfois le rejet de cet enseignement supplémentaire de la part des jeunes qui le considèrent comme une charge de plus à assumer, qui stigmatise leur différence par rapport à leurs camarades, et préfèrent être "égaux" et ignorer la langue et la culture d'origine de leurs parents et grands-parents.

Without prejudice to the provisions of this Directive, in particular those concerning the obligations relating to the advertising of awarded contracts and to the information to candidates and tenderers set out in Articles 43 and 49, and in accordance with the national law to which the contracting entity is subject, the contracting authority shall not disclose information forwarded to it by economic operators which they have designated as confidential; such information includes, in particular, technical or trade secrets and the confidential aspects of tenders.

In the interests, moreover, of still greater efficiency, it recommends orders in the military sector, something that, in addition, would enable manufacturers to benefit from the knowledge already acquired in this area and would move in the direction of establishing a European military force independent of that of the United States – a military force which some people consider vital to conducting operations that they refer to as ‘peacekeeping’, but which are nothing other than operations for defending the interests of European manufacturers and financiers.

They would be unable to operate if they did not receive the necessary information within the set time periods. In our experience, the difficulties many petitioners encounter with regard to these petitions are twofold. Not only do they experience difficulty in understanding Community law – which is often complex and difficult to grasp – but they also have difficulty in obtaining from local, regional and national administrations sufficient information to enable them to submit their petitions to the Committee on Petitions in the approved manner. The same applies to complaints to the European Commission, as the Commissioner is well aware.
Notre expérience est que dans bon nombre de ces pétitions, les difficultés que rencontrent ceux qui les rédigent est de comprendre le droit communautaire - parfois très complexe et très difficile à aborder -, mais aussi d'obtenir des administrations locales, régionales et nationales suffisamment d'informations pour présenter les pétitions en bonne et due forme à la commission des pétitions et parfois pour déposer les plaintes à la Commission européenne, situation que connaît également la commissaire.
