Article 2(2)(b)(i) of Council Directive 2008/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation must be interpreted as precluding national legislation under which an employer may dismiss a worker on the grounds of his intermittent absences from work, even if justified, in a situation where those absences are the consequence of sickness attributable to a disability suffered by that worker, unless that legislation, while pursuing the legitimate aim of combating absenteeism, does not go beyond what is necessary in order to achieve that aim, which is a matter for the referring court to assess.
L’article 2, paragraphe 2, sous b), i), de la directive 2000/78/CE du Conseil, du 27 novembre 2000, portant création d’un cadre général en faveur de l’égalité de traitement en matière d’emploi et de travail, doit être interprété en ce sens qu’il s’oppose à une réglementation nationale qui prévoit qu’un employeur peut licencier un travailleur pour le motif tiré d’absences intermittentes au travail, fussent-elles justifiées, dans la situation où ces absences sont la conséquence de maladies imputables au handicap dont est atteint ce travailleur, sauf si cette réglementation, tout en poursuivant l’objectif légitime de lutter contre l’absentéisme, n’excède pas ce qui est nécessaire pour atteindre cet objectif, ce qu’il appartient à la juridiction de renvoi d’apprécier.

Enormous progress is needed in the field of education in order to overcome illiteracy (which affects 80 % of the population), particularly among women (the female illiteracy rate is the highest in the world), and to combat school absenteeism among six to eleven-year-olds (which stands at 64 % and affects over one million children), the shortage of teachers and shortcomings in the field of professional training.
En matière d'éducation, des progrès énormes doivent être menés pour pallier l'analphabétisme (80 % de la population), surtout féminin - le plus élevé dans le monde- ou encore l'absentéisme à l'école des enfants de 6 à 11 ans (plus d'1 millions, soit 64 %), la pénurie d'enseignants et les insuffisances dans la formation professionnelle.
