The trans-European combined transport network comprises railways and inland waterways, which are suitable for combined transport and maritime links which permit the long-distance transport of goods, and intermodal terminals equipped with installations permitting transhipment between railways, inland waterways, shipping routes and roads.

Therefore, Directive 92/106/EEC provides that in order for a road transport operation to be considered as an initial or final leg of a combined road-sea transport operation, the maritime section of the combined transport needs to exceed 100 km and the distance between the port where the trailer is picked up and the final destination of the goods by road must not exceed 150 km. In this case, the initial or final road leg does not fall under the definition of "cabotage", and is therefore not subject to Regulation (EC) No 1072/2009.

With regard to international maritime transport, including intermodal operations involving a sea leg, nationals of the Member States or of the Republic of Tajikistan established outside the Community or the Republic of Tajikistan respectively, and shipping companies established outside the Community or the Republic of Tajikistan and controlled by nationals of a Member State or nationals of the Republic of Tajikistan respectively, shall also be beneficiaries of the provisions of this Chapter and Chapter III if their vessels are registered in that Member State or in the Republic of Tajikistan respectively in accordance with their respective legislation.
