4. For the fishery and aquaculture products, listed in Annex I TFEU, to which Articles 107, 108 and 109 thereof apply, the Commission may authorise, in accordance with Article 108 TFEU, operating aid in the outermost regions referred to in Article 349 TFEU within the sectors producing, processing and marketing fishery and aquaculture products, with a view to alleviating the specific constraints in those regions as a result of their isolation, insularity and extreme remoteness.
4. Pour les produits de la pêche et de l’aquaculture énumérés à l’annexe I du traité sur le fonctionnement de l’Union européenne, auxquels les articles 107, 108 et 109 dudit traité s’appliquent, la Commission peut autoriser, en conformité avec l’article 108 du traité sur le fonctionnement de l’Union européenne, dans les régions ultrapériphériques visées à l’article 349 du traité sur le fonctionnement de l’Union européenne, des aides au fonctionnement dans les secteurs de la production, de la transformation et de la commercialisation des produits de la pêche et de l’aquaculture, visant à alléger les contraintes spécifiques à ces régions liées à leur éloignement, à leur insularité et à leur ultrapériphéricité.

1. The Commission may authorise any Member State to conclude an agreement with a third country or with a territory outside the territorial scope of the TEU and the TFEU as referred to in Article 355 TFEU (the ‘country or territory concerned’), which contains derogations from this Regulation, in order to allow transfers of funds between that country or territory and the Member State concerned to be treated as transfers of funds within that Member State.

La Commission peut autoriser tout État membre à conclure un accord avec un pays tiers ou un territoire ne relevant pas du champ d'application territoriale du traité sur l'Union européenne et du traité sur le fonctionnement de l'Union européenne tel qu'il est visé à l'article 355 du traité sur le fonctionnement de l'Union européenne (ci-après dénommé «pays ou territoire concerné»), qui contient des dérogations au présent règlement, afin de permettre que les transferts de fonds entre ce pays ou territoire et l'État membre concerné soient traités comme des transferts de fonds effectués à l'intérieur de cet État membre.

In exceptional cases duly justified for technical and historical reasons , the Commission may authorise specific derogations until the end of 2015 in response to a duly motivated application from the Member State concerned .

3. Contracts and agreements resulting from this Regulation shall provide in particular for supervision and financial control by the Commission, or any representative that the Commission may authorise, and for audits by the Court of Auditors, if necessary on-the-spot.

1. The Council, acting unanimously on a proposal from the Commission, may authorise any Member State to conclude with a third country or an international organisation an agreement which may contain derogations from this Directive.
