The EESC is concerned about the potential danger of creating large groups in some sectors, which may lead to serious distortions of competition, in the destruction of various SMEs and influence consumer choices. The Committee urges the Commission to be vigilant.
Le CESE fait part de son inquiétude quant au risque que dans certains secteurs, il ne se crée de grands groupes, pouvant ainsi aboutir à créer de graves distorsions de concurrence, détruire de nombreuses PME et conditionner les choix des consommateurs; aussi demande-t-il à la Commission de se montrer vigilante.

As the implementing acts provided for by this Decision concern the protection of human health, the Commission may not adopt a draft implementing act where the Committee on serious cross-border threats to health delivers no opinion, in accordance with point (a) of the second subparagraph of Article 5(4) of Regulation (EU) No 182/2011.

RECALLS Decision No 1082/2013/EU of the European Parliament and of the Council of 22 October 2013, on serious cross-border threats to health and repealing Decision No 2119/98/EC (2), which provides that Member States shall consult each other in liaison with the Commission through the Health Security Committee with a view to coordinating their response to serious cross-border threats to health, including communicable diseases.
RAPPELLE la décision no 1082/2013/UE du Parlement européen et du Conseil du 22 octobre 2013 relative aux menaces transfrontières graves sur la santé et abrogeant la décision no 2119/98/CE (2), qui prévoit que les États membres se concertent, en liaison avec la Commission, via le comité de sécurité sanitaire en vue de coordonner leur réaction à des menaces transfrontières graves pour la santé, y compris les maladies transmissibles.

the term ‘serious casualty’ shall be understood in accordance with the updated definition contained in Circular MSC-MEPC.3/Circ.3 of the IMO Maritime Safety Committee and Marine Environment Protection Committee of 18 December 2008;

5. The European Parliament and the Council, acting in accordance with the ordinary legislative procedure and after consulting the Economic and Social Committee and the Committee of the Regions, may also adopt incentive measures designed to protect and improve human health and in particular to combat the major cross-border health scourges, measures concerning monitoring, early warning of and combating serious cross-border threats to health, and measures which have as their direct objective the protection of public health regarding tobacco and the abuse of alcohol, excluding any harmonisation of the laws and regulations of the Member States.
5. Le Parlement européen et le Conseil, statuant conformément à la procédure législative ordinaire et après consultation du Comité économique et social et du Comité des régions, peuvent également adopter des mesures d'encouragement visant à protéger et à améliorer la santé humaine, et notamment à lutter contre les grands fléaux transfrontières, des mesures concernant la surveillance des menaces transfrontières graves sur la santé, l'alerte en cas de telles menaces et la lutte contre celles-ci, ainsi que des mesures ayant directement pour objectif la protection de la santé publique en ce qui concerne le tabac et l'abus d'alcool, à l'exclusion de toute harmonisation des dispositions législatives et réglementaires des États membres.

The Committee has serious doubts about the soundness of these limits, particularly as regards initial capital: an amount of ECU (euro) half a million is certainly not enough to begin a proper activity, however limited its scope.
