Whereas in the light of the recent modifications adapting the rules at procedure relating to Community transit, it is convenient to adapt the Additional Protocol ES-PT on special procedures implementing the Convention on a common transit procedure following the accession of the Kingdom of Spain and the Portuguese Republic to the Community,
considérant que, en fonction des modifications apportées récemment à la réglementation relative au transit communautaire, il convient d'adapter le protocole additionnel ES-PT concernant les modalités particulières d'application de la convention relative à un régime de transit commun rendues nécessaires par l'adhésion du royaume d'Espagne et de la République portugaise à la Communauté,

Due to the need to comply with international agreements, the Commission should be empowered to modify the technical procedures for the calculation methods concerning thresholds as well as to periodically revise the thresholds themselves; references to the CPV nomenclature may undergo regulatory changes at Union level and it is necessary to reflect those changes into the text of this Directive; the technical details and characteristics of the devices for electronic receipt should be kept up to date with technological developments; it is also necessary to empower the Commission to make mandatory certain technical standards for electronic communication to ensure the interoperability of technical formats, processes and messaging in procurement procedures conducted using electronic means of communication taking into account technological developments; the Commission should also be empowered to adapt the list of legislative acts of the Union establishing common methodologies for the calculation of life-cycle costs; the list of International Social and Environmental Conventions and the list of Union legislation whose implementation creates a presumption of free access to a given market as well as Annex II„ setting out a list of legal acts to be taken into account when assessing the existence of special or exclusive rights, should be quickly adapted to incorporate the measures adopted on a sectoral basis.
Eu égard à la nécessité de se conformer aux accords internationaux, la Commission devrait être habilitée à modifier les modalités techniques des méthodes de calcul des seuils et à réviser périodiquement les seuils eux-mêmes; les références à la nomenclature CPV étant susceptibles de faire l’objet de modifications réglementaires au niveau de l’Union, il est nécessaire d’intégrer ces modifications dans le texte de la présente directive; les détails et les caractéristiques techniques des dispositifs de réception électronique devraient être actualisés en fonction de l’évolution des technologies; il est également nécessaire d’habiliter la Commission à imposer des normes techniques de communication électronique, afin d’assurer l’interopérabilité des formats techniques, des procédures et des messageries dans le cadre des passations de marché par voie électronique, en tenant compte de l’évolution des technologies; pour intégrer les mesures adoptées au niveau sectoriel, il conviendrait d’habiliter également la Commission à adapter rapidement la liste des actes législatifs de l’Union établissant des méthodes communes de calcul des coûts du cycle de vie, la liste des conventions internationales en matière sociale et environnementale, la liste des actes juridiques de l’Union dont la mise en œuvre crée une présomption de libre accès à un marché, et l’annexe II qui énumère les actes à prendre en considération pour établir l’existence de droits spéciaux ou exclusifs; pour répondre à cette nécessité, la Commission devrait être habilitée à actualiser ces listes.

Whereas at the single market stage, in view of the fact that price systems are standardised and the agricultural policy is a Community policy, the financial consequences devolve upon the Community ; whereas, in accordance with that principle, as laid down in Article 2 (2) of that Regulation, refunds on exports to third countries, intervention aimed at stabilising agricultural markets, and common measures adopted in order to achieve the objectives set out in Article 39 (1) (a) of the Treaty, including structural adaptation required for the proper working of the common market, are financed by the Fund;
considérant que, au stade du marché unique, les systèmes de prix étant unifiés et la politique agricole étant communautaire, les conséquences financières qui en résultent incombent à la Communauté ; que sont financées par le Fonds, en vertu de ce principe tel qu'il figure à l'article 2 paragraphe 2 dudit règlement, les restitutions à l'exportation vers les pays tiers, les interventions destinées à la régularisation des marchés agricoles et les actions communes décidées en vue de réaliser les objectifs définis à l'article 39 paragraphe 1 sous a) du traité, y compris les modifications de structure nécessaires au bon fonctionnement du marché commun;
