By their appeal, Akzo Nobel Chemicals Ltd (‘Akzo’) and Akcros Chemicals Ltd (‘Akcros’) seek to have set aside the judgment of the Court of First Instance of the European Communities (now ‘the General Court’) of 17 September 2007 in Joined Cases T-125/03 and T-253/03 Akzo Nobel Chemicals and Akcros Chemicals v Commission (‘the judgment under appeal’), in so far as it rejected the claim of legal professional privilege for correspondence with Akzo’s in-house lawyer.

With regard to injury caused by the ITC, the Commission considers that although AKZO did not proved that actual damage is being caused to Community industry by the ITC decision, nevertheless the evidence it presented of a threat of injury is convincing, since the company is losing direct sales on the US market and on the Community market up to 1990 and beyond.
