IN-CONTEXT TRANSLATIONS

On 5 October 2006 the Court upheld the Commission's position when it ruled that certain Member States were wrong to refuse to pay certain categories of resources into the Community budget, in this case instalments of traditional own resources recovered under a payment plan (Belgium)[14] and guaranteed and uncontested duties resulting from undischarged transit operations conducted in the form of Community transit (Belgium)[15] or under a TIR carnet (Germany[16] and Belgium).[17] On the same day the Court rejected a case brought against the Netherlands in connection with the burden of proof, but agreed that Member States must report infringements or irregularities as soon as they are aware of them and thus before expiry of the time limits (Article 11(1) of the TIR Convention); this applies mutatis mutandis to payment demands (Article 11(2) of the TIR Convention).
Il convient également de noter que le 5 octobre 2006, la Cour a confirmé la position de la Commission et considéré que c'était à tort que certains Etats membres refusaient de verser au budget communautaire certaines catégories de montants, à savoir les montants de RPT recouvrés partiellement dans le cadre d'un plan de paiement échelonné (Belgique[14]) et des montants de droits garantis et non contestés dans le cadre d'opérations de transit non apurées effectuées en tant que transits communautaires (Belgique[15]) ou sous couvert de carnets TIR (Allemagne[16] et Belgique[17]). La Cour, le même jour, a rejeté le recours contre les Pays-Bas pour une raison liée à la charge de la preuve tout en reconnaissant que les Etats membres doivent communiquer une infraction ou irrégularité dès qu'ils en ont pris connaissance et donc, le cas échéant, avant l'expiration des délais (art.11§1 de la Convention TIR), la même chose valant mutatis mutandis pour la demande de paiement (art. 11§2 de la Convention TIR).

[4] For the moment, two possibilities can be envisaged: either a contribution paid by Belgium to the GALILEO Joint Undertaking and equivalent to the amount of the charges paid by the latter, or the application by Belgium of the Protocol on Privileges and Immunities, on the grounds that the Joint Undertaking was set up by a Community Regulation on the basis of Article 171 of the Treaty.

By letter of 1 February 2002, the Council consulted Parliament, pursuant to Article 39 of the EU Treaty, on the initiative of the Kingdom of Belgium and the Kingdom of Spain with a view to adopting a Council Act drawing up a Protocol amending the Convention on the establishment of a European Police Office (Europol Convention), the Protocol on the interpretation, by way of preliminary rulings, by the Court of Justice of the European Communities of the Convention on the establishment of a European Police Office and the Protocol on the privileges and immunities of Europol, the members of its organs, the deputy directors and the employees of Europol (5455/2002 – 2002/0804(CNS)).

Following an initiative from Sweden and Belgium, the Council now proposes to replace the existing SIS by a second-generation system, SIS II. The Council justifies this with several reasons, including the new needs resulting from the future enlargement of the Community.
