(4) Community patent law applicable to the Community patent should not replace the laws of the Member States on patents, nor European patent law as established by the Munich Convention. It would not in fact appear to be justified to require undertakings to apply for registration of their patents as Community patents, since national patents and European patents continue to be necessary for those undertakings which do not want protection of their inventions at Community level. This Regulation should therefore be without prejudice to the right of the Member States to grant national patents.

Whereas the Disciplinary Committee rules on any breach of duty by the official concerned, particularly in the light of his obligations under the Staff Regulations and, more generally, compliance with EU law, and its opinion may lead the official’s institution to adopt a decision which may be favourable or unfavourable to him, the situation is entirely different with the decision to communicate information, since OLAF merely communicates to the national judicial authorities information which those authorities alone are responsible for assessing from the point of view of criminal law.

As a matter of policy, the Commission has always considered support for broadband network deployment in rural and underserved white areas to be in line with existing Community policies, since it promotes territorial social and economic cohesion and addresses market failures.

En raison du plan d'action 2006-2008 pour la simplification et l'amélioration de la politique commune de la pêche, présenté dans la communication de la Commission au Conseil et au Parlement du 8 décembre 2005, et de l'évolution de la pêche en dehors des eaux communautaires depuis l'adoption du règlement (CE) no 3317/94, et pour se conformer aux obligations internationales, il est nécessaire d'introduire un système communautaire général pour l'autorisation de toutes les activités de pêche des navires de pêche communautaires en dehors des eaux communautaires.

However, your rapporteur would point out that this process is beyond the influence of the Community institutions, since it relates to a stage after the adoption of Community legislative acts for which responsibility lies with national administrations and courts.
