A. whereas the Court of Auditors stated that it has obtained reasonable assurances that the annual accounts of the Community Fisheries Control Agency ("the Agency") for the financial year 2011 are reliable and that the underlying transactions are legal and regular,

1. Grants the Executive Director of the Community Fisheries Control Agency discharge in respect of the implementation of the Agency's budget for the financial year 2011;

OLAF may carry out investigations, including on-the-spot checks and inspections, in accordance with the provisions and procedures laid down in Regulation (EC) No 1073/1999 and Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities (22) with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the financial interests of the Union in connection with a grant or a contract funded by the Agency.
3. L’OLAF peut effectuer des enquêtes, y compris des contrôles et vérifications sur place, selon les dispositions et modalités prévues par le règlement (CE) no 1073/1999 et le règlement (Euratom, CE) no 2185/96 du Conseil du 11 novembre 1996 relatif aux contrôles et vérifications sur place effectués par la Commission pour la protection des intérêts financiers des Communautés européennes contre les fraudes et autres irrégularités (22), en vue d’établir l’existence éventuelle d’une fraude, d’un acte de corruption ou de toute autre activité illégale portant atteinte aux intérêts financiers de l’Union, dans le cadre d’une subvention ou d’un contrat financés par l’Agence.

The Trans-European Transport Network Executive Agency (hereinafter referred to as the Agency) was set up by Commission Decision 2007/60/EC (2) of 26 October 2006, to manage the Community action in the field of the trans-European transport network until 31 December 2008 for the implementation of tasks concerning the granting of Community financial aid pursuant to Council Regulation (EC) No 2236/95 of 18 September 1995 laying down general rules for the granting of Community financial aid in the field of the trans-European networks (3).
L’agence exécutive du réseau transeuropéen de transport (dénommée ci-après «l’agence») a été instituée par la décision 2007/60/CE de la Commission (2) pour gérer, jusqu’au 31 décembre 2008, l’action communautaire dans le domaine du réseau transeuropéen de transport en vue de l’exécution des tâches concernant l’octroi du concours financier communautaire au titre du règlement (CE) no 2236/95 du Conseil du 18 septembre 1995 déterminant les règles générales pour l’octroi d’un concours financier communautaire dans le domaine des réseaux transeuropéens (3).

Points out that Council Regulation (EC) No 58/2003 of 19 December 2002 laying down the statute for executive agencies to be entrusted with certain tasks in the management of Community programmes requires, in its Article 3(1), a cost-benefit analysis, taking into account a number of factors, before the establishment of an executive agency can be requested; regrets that the Commission was not in a position to present the European Court of Auditors with a satisfactory cost-benefit analysis of the establishment of an executive agency at the outset; remains, together with the European Court of Auditors, doubtful with regard to the quality of the revised version of the cost-benefit analysis concerning the externalisation of the management of Community financial support to the TEN-T networks; for the future, calls on the Commission to seek a positive opinion on cost-benefit analyses from the European Court of Auditors before forwarding a request for the establishment of an executive agency to the budgetary authorities;
202. fait observer que le règlement (CE) n° 58/2003 du Conseil du 19 décembre 2002 portant statut des agences exécutives chargées de certaines tâches relatives à la gestion de programmes communautaires requiert, en son article 3, paragraphe 1, une analyse coûts/avantages tenant compte de plusieurs facteurs avant que la demande de création d'une agence exécutive puisse être faite; déplore que la Commission n'ait pas été en mesure de soumettre à la Cour, dès le départ, une analyse satisfaisante coûts/avantages de la création d'une agence exécutive; reste dubitatif, à l'instar de la Cour, quant à la qualité de la version révisée de l'analyse coûts/avantages concernant l'externalisation de la gestion du soutien financier communautaire apporté aux réseaux RTE-T; à l'avenir, invite la Commission à demander un avis positif à la Cour concernant les analyses coûts/avantages avant de solliciter de la part des autorités budgétaires la création d'une agence exécutive;

they have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Communities' or the Agency's financial interests;

(4) While the Council Regulation (EC) No 2007/2004 of 26 October 2004 establishing a European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union[39] (hereafter referred to as “the Agency”)constitutes an important step towards the progressive development of the operational dimension of the common integrated border management system, the implementation of effective and common standards for control and surveillance of the external borders calls for a Community financial solidarity mechanism in order to support the Member States who endure, for the benefit of the Community, a lasting and heavy financial burden.
(4) Alors que le règlement du Conseil (CE) n° 2007/2004 du 26 octobre 2004 portant création d'une Agence européenne pour la gestion de la coopération opérationnelle aux frontières extérieures des États membres de l'Union européenne[39] (dénommée ci-après «l'Agence») constitue une étape importante vers le développement progressif de la dimension opérationnelle du système commun intégré de gestion des frontières, la mise en place de normes communes efficaces en matière de contrôle et de surveillance des frontières extérieures appelle un mécanisme communautaire de solidarité financière visant à soutenir les États membres qui supportent, au profit de la Communauté, une charge financière lourde et durable.
