· reduce the 'Rotterdam effect' resulting (a) in an over-representation in external trade statistics of Member States having a high level of customs clearance or export but playing only the role of transit countries to the detriment of the Member States of actual destination or dispatch of the goods and (b) in a double reporting of the same goods in Extrastat as non Community goods and then in Intrastat as Community goods coming from another Member States, with a comparable situation at export;

The presumption will apply to goods that have been shipped between ports in the Community customs territory on board a vessel that does not come from, go to or call at any ports outside this territory or in a free zone of control type I (as stipulated in the Implementing Provisions of the Community Customs Code), provided that they are carried under cover of a single transport document drawn up in a Member State. Non-Community goods carried on board these vessels will be covered by a transit procedure.

The operator, agent or master of a ship carrying dangerous or polluting goods coming from a port located outside the Community and bound for a port located in the Community or an anchorage located in a Member State's territorial waters shall, at the latest upon departure from the loading port or as soon as the port of destination is known, if this information is unavailable at the moment of departure, notify the information indicated in Annex III to the competent authority of the Member State in which the first port of destination or anchorage is located.

(a) in the Community, only when the goods satisfy the conditions laid down in Articles 9 and 10 of the Treaty establishing the European Economic Community and have not been subject to customs export formalities for the grant of refunds for export to countries, not Member States of the Community, pursuant to the common agricultural policy or when the goods come under the Treaty establishing the European Coal and Steel Community and are, under the terms of that Treaty, in free circulation within the Community (Community goods);

THIS DIRECTIVE PRESCRIBES THE RULES WHICH MUST BE INCORPORATED IN THE PROVISIONS LAID DOWN BY LAW , REGULATION OR ADMINISTRATIVE ACTION IN MEMBER STATES IN RESPECT OF CUSTOMS TREATMENT OF GOODS ENTERING THE CUSTOMS TERRITORY OF THE COMMUNITY OR COMING FROM A FREE ZONE SITUATED IN THE TERRITORY OF THE COMMUNITY , AND ALSO THE RULES CONCERNING PROVISIONAL DEPOSIT OF THOSE GOODS WHERE SUCH A SYSTEM EITHER EXISTS OR IS PLANNED WITHIN A MEMBER STATE .
