In November 1999, Member States considered that the Community had to obtain a European laboratory network for detection and the identification of the GMO in food, field in which the JRC had strongly invested itself, at the request of DGs SANCO and DG ENV. Without prejudice to the cases where the ECB had decided to exercise directly itself supervisory tasks for credit institutions pursuant to Article 6(5)(b) of Regulation (EU) No 1024/2013, in case of a communication pursuant to paragraph 1, or where the Board intends to take a decision under paragraph 1 on its own initiative, in relation to an entity or group referred to in Article 6a(3), the Board shall communicate that assessment without delay to the ECB.

4. The home Member State may exempt issuers only in respect of those debt securities which have already been admitted to trading on a regulated market in the Community prior to 1 January 2005 from disclosing half-yearly financial report in accordance with Article 5 for 10 years following 1 January 2005, provided that the home Member State had decided to allow such issuers to benefit from the provisions of Article 27 of Directive 2001/34/EC at the point of admission of those debt securities.
4. L'État membre d'origine peut exempter l'émetteur de l'obligation de publier des rapports financiers semestriels conformément à l'article 5 pendant dix ans à partir du 1er janvier 2005, seulement en ce qui concerne les titres de créance déjà admis à la négociation sur un marché réglementé de la Communauté avant le 1er janvier 2005, à condition que l'État membre d'origine ait décidé de permettre à ces émetteurs de bénéficier des dispositions de l'article 27 de la directive 2001/34/CE au moment de l'admission desdits titres de créance.

Noting that this Directive had been extensively interpreted by the Court of Justice over the years and that the introduction of citizenship of the Union changed the context in which the Directive had to be interpreted, and taking account of the lessons to be learnt from the many complaints by citizens about implementation of the Directive, the Commission decided to adopt a communication with the aim of drawing attention to the main difficulties raised by implementation of this Directive and of providing certain guidelines on how to resolve these difficulties.
La Commission, constatant que cette directive a été abondamment interprétée par la Cour de justice au fil des ans, que l'introduction de la citoyenneté de l'Union modifie le contexte dans lequel s'inscrit l'interprétation de la directive, mais aussi tenant compte des leçons tirées à partir des nombreuses plaintes de citoyens concernant l'application de la directive, décida d'adopter une communication, dans le but d'attirer l'attention sur les principales difficultés soulevées par l'application de cette directive et d'offrir quelques orientations quant à la manière de résoudre ces difficultés.
