Since the objective of this Directive, namely further developing and improving safety on the Community’s railways, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale of the action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

(9) The objectives of the proposed action, namely the development of the Community's railways, cannot be sufficiently achieved by the Member States given the need to ensure fair and non-discriminatory conditions of access to infrastructure and to take account of the obviously international dimension of the way in which important parts of the rail networks operate. Because of the need for co-ordinated transnational action, these can be better achieved at Community level, so the Community may adopt measures in accordance with the principle of subsidiarity enshrined in Article 5 of the Treaty.

Since the objective of this Regulation, namely the extension of the Agency's mission to include its participation in the simplification of the Community procedure for the certification of railway vehicles, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale of the action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity set out in Article 5 of the Treaty.
Étant donné que l'objectif du présent règlement, à savoir l'extension de la mission de l'Agence afin de prévoir sa participation à la simplification de la procédure communautaire de certification des véhicules ferroviaires, ne peut pas être réalisé de manière suffisante par les États membres et peut donc, en raison des dimensions de l'action, être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité.

(15) In accordance with the principles of subsidiarity and proportionality as set out in Article 5 of the Treaty, the objectives of this Directive, namely to develop the Community's railways, cannot be sufficiently achieved by the Member States in view of the need to ensure fair and non-discriminatory terms for access to the infrastructure as well as to take account of the manifestly international dimensions involved in the operation of significant elements of the railway networks, and can therefore, by reason of the need for coordinated trans-national action, be better achieved by the Community.
(15) Conformément au principe de subsidiarité et au principe de proportionnalité, tels qu'énoncés à l'article 5 du traité, les objectifs de la présente directive, à savoir le développement des chemins de fer communautaires, ne peuvent pas être réalisés de manière suffisante par les États membres, compte tenu de la nécessité d'assurer des conditions d'accès à l'infrastructure équitables et non discriminatoires et de tenir compte de la dimension manifestement internationale du fonctionnement d'éléments importants des réseaux ferroviaires, et peuvent donc, en raison de la nécessité d'une action transnationale coordonnée, être mieux réalisés au niveau communautaire.

(49) In accordance with the principles of subsidiarity and proportionality as set out in Article 5 of the Treaty, the objectives of this Directive, namely to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof as well as safety certification, cannot be sufficiently achieved by the Member States in view of the need to ensure fair and non-discriminatory terms for access to the infrastructure as well as to take account of the manifestly international dimensions involved in the operation of significant elements of the railway networks, and can therefore, by reason of the need for coordinated trans-national action, be better achieved by the Community.
(49) Conformément au principe de subsidiarité et au principe de proportionnalité tels qu'énoncés à l'article 5 du traité, les objectifs de la présente directive, à savoir la coordination des systèmes des États membres régissant la répartition des capacités d'infrastructure ferroviaire et la perception de redevances d'utilisation de ladite infrastructure ainsi que la délivrance des certificats de sécurité, ne peuvent pas être réalisés de manière suffisante par les États membres, compte tenu de la nécessité d'assurer des conditions équitables et non discriminatoires pour l'accès à l'infrastructure et de tenir compte de la dimension manifestement internationale du fonctionnement d'éléments importants des réseaux ferroviaires, et peuvent donc être mieux réalisés au niveau communautaire en raison de la nécessité d'une action transnationale coordonnée.
