Are Articles 45 and 49 TFEU and Directive 2005/36 of 7 September 2005 on the recognition of professional qualifications to be interpreted as applying in a situation where a Belgian national, who resides in Belgium and who has not pursued a professional activity (1) in another Member State, relies in support of his application to participate in a competition to recruit legal secretaries at the Belgian Cour de cassation on a degree awarded by a French university, namely a vocational master’s degree in law, economics and management, private law, lawyer-linguist specialism, awarded on 22 November 2010 by the University of Poitiers in France?
Les articles 45 et 49 du Traité sur le fonctionnement de l’Union européenne ainsi que la directive 2005/36/CE du 7 septembre 2005 relative à la reconnaissance des qualifications professionnelles (1) doivent-ils être interprétés comme s’appliquant dans une situation dans laquelle un ressortissant de nationalité belge, qui réside en Belgique et qui n’a pas exercé d’activité professionnelle dans un autre État membre, se prévaut à l’appui de sa demande de participation à un concours de recrutement de référendaires près la Cour de cassation belge d’un diplôme délivré par une université française, à savoir un master en droit, économie, gestion, à finalité professionnelle, mention droit privé, spécialité juriste-linguiste délivré le 22 novembre 2010 par l’université française de Poitiers?

In view of the selection board’s wide discretion in deciding on the content and arrangements for the tests in a competition, the identical treatment of all the candidates and the use by all of the BDS keyboard alone are justified by the nature and purpose of the competition, which was a specialised competition to select a number of highly skilled lawyer-linguists for the Court of Justice, where all Bulgarian lawyer-linguists use the standard BDS keyboard.
Compte tenu du large pouvoir d’appréciation dont dispose le jury quant au contenu et aux modalités des épreuves d’un concours, le traitement identique de tous les candidats et l’utilisation par tous du seul clavier BDS sont justifiés par la nature et la finalité du concours, s’agissant d’un concours spécialisé, visant à sélectionner un certain nombre de juristes linguistes hautement qualifiés pour la Cour de justice, où tous les juristes linguistes bulgares utilisent le clavier normalisé BDS.

The fact that a candidate in an open competition to constitute a reserve pool of Bulgarian-language lawyer-linguists used a phonetic keyboard rather than a BDS keyboard prior to the competition and that he did not familiarise himself with the BDS keyboard, even though he was told that it would be used for the tests, is a circumstance particular to the candidate which cannot constitute a difference capable of resulting in a breach of the principle of equal treatment.
Le fait qu’un candidat à un concours général pour la constitution d’une réserve de recrutement de juristes linguistes de langue bulgare a, antérieurement au concours, utilisé un clavier phonétique plutôt qu’un clavier BDS et qu’il ne s’est pas familiarisé avec le clavier BDS alors qu’il a été informé que ce clavier serait utilisé pour les épreuves relève d’une circonstance propre au candidat laquelle ne saurait constituer une différence susceptible d’entraîner une violation du principe d’égalité de traitement.

On 22 May 2008 EPSO published in the Official Journal of the European Union (OJ 2008 C 125 A, Spanish language edition, p. 1) notice of open competition EPSO/AD/130/08 (‘the notice of competition’), held in order to draw up a reserve list of lawyer-linguists (Grade AD7) with Spanish as their main language from which to fill vacant posts in the institutions of the European Union, in particular, the Court of Justice of the European Union, the European Parliament and the Council of the European Union.
