In the present case, it is clear from the documents in the case that the action before the Tribunal was brought within the time-limit of three months laid down in the Staff Regulations, extended on account of distance by a single period of 10 days from the date on which the applicant received notification that the complaint had been rejected; that the applicant challenges the decision regarding his grading on his appointment as a temporary agent, which he regards as adversely affecting him, and that he has a legal interest in bringing proceedings since he is challenging an administrative decision of individual application producing binding legal effects that directly and immediately affect his interests.

In particular, ordering the institution to pay the costs, even though it is the successful party, may be justified by lack of due diligence in the pre-litigation procedure where, first, it allowed the period of four months laid down in Article 90(1) of the Staff Regulations to elapse before adopting an express decision rejecting the request made by the official concerned, and second, it did not draw the official’s attention, in the decision at issue, to the fact that an implied rejection decision had already been taken and that the time-limit of three months for lodging a complaint had started running from that decision.

In that regard, the applicant adds that an e-mail on which the sender’s e-mail address had the same domain name as that on EPSO’s e-mails, which responded to what she had asked for in her complaint and which made express reference to that complaint, without however upholding her complaint, must be regarded as a rejection of her complaint.
