When the Commission initiated the procedure, it was concerned that several provisions of the agreement contained State aid, which could at the time not be quantified or assessed as to their compatibility with the Treaty. The Dutch authorities and the industrial parties emphasized in their submissions that all elements of the transaction have to be seen as a whole and that, by doing this, it would become clear that the Dutch State realized the best possible outcome.
