When it was pointed out that the Constitutional Amendment Act of British Columbia provides that the government must not introduce a motion for a resolution of the legislative assembly authorizing an amendment to the Constitution of Canada unless a referendum had first been conducted under the Referendum Act with respect to the subject matter of that resolution, the premier said that the Nisga'a agreement did not amount to an amendment to the Constitution of Canada so there was no need for a referendum.
