In this respect, the applicant argues that if the Commission, before 8 August 2008 (the date on which the applicant approved an amendment to the restructuring plan concerning the preservation of the silos), had answered the applicant’s written question about the preservation of certain structures, if it had amended and supplemented Regulation No 968/2006 (1) and if, having received the communication relating to the alteration of the restructuring programme, it had informed the applicant of the alleged irregularity concerning the preservation of the silos, or if it had written to all the Member States informing them of its interpretation of the unclear provisions of the relevant legislation, the financial correction at issue would not have been made and the contested decision would not have been adopted.

In the event that evidence is obtained in breach of Articles 7, 8, 41 and 48 of the Charter, in conjunction with Article 47 of the Charter, does national legislation under which the challenging in judicial proceedings of the procedural legality of decisions given in tax matters can only succeed and result in the setting aside of the decision if, according to the circumstances of the case, there is the possibility in practice that the contested decision would have been different if the procedural error had not occurred and if, moreover, that defect affected the substantive legal position of the applicant, or do the procedural errors made in that way have to be taken into account in a wider context, regardless of the influence the procedural error which infringes the Charter has on the outcome of the proceedings?

In support of the action, the applicant puts forward a single plea in law, alleging an infringement by the Commission of Articles 107 and 108 TFEU and of the principle of proportionality, in that the contested decision would impose on Belgium, in addition to the obligation to recover the aid from the recipient cooperative undertakings, a prohibition on making any payment to natural persons protected by the guarantee.

In contrast, the single European patent contemplated by the contested decision would confer uniform protection in the territory of all the Member States taking part in the enhanced cooperation.

The applicant claims in that regard that, in tersely confirming in the contested decision that the error in the title of the amending decision of 31 December 2012 had no effect on the content of the decision itself or on the implementation of the programme, the Commission neglected to take into consideration the relevance of the following circumstances: (i) the spending decisions adopted by the Region had to be checked beforehand by the Court of Auditors; (ii) four months had elapsed between the correction being announced and the correction being implemented, without any explanation being provided; (iii) that fact had the potential to arouse the suspicion that the correction to be made was of greater importance than a correction supposedly relating only to the title of the decision of 31 December 2012; and (iv) the Court of Auditors had confirmed that the course of action taken by the Region, which refrained from adopting the commitments until the correction was officially recognised (28 March 2013), was correct, thus giving it to be understood that the opposite course of action would not have been correct.
Il est soutenu à cet égard que, dans la décision attaquée, en affirmant de manière lapidaire que l’erreur contenue dans le titre de la décision modificatrice du 31 décembre 2012 n’a eu aucun effet sur le contenu de la décision elle-même et sur la mise en œuvre du programme, la Commission n’aurait pas tenu compte de la l’importance du fait que les décisions relatives aux frais adoptées par la Région devaient être préalablement contrôlées par la Cour des comptes; que quatre mois se sont écoulés entre l’annonce de la correction et sa réalisation, sans qu’aucune explication ne soit fournie; que ceci a pu susciter le doute que la rectification à effectuer aurait été plus importante que celle annoncée comme se limitant au seul titre de la décision du 31 décembre 2012 et que la Cour des comptes a confirmé que l’action de la Région, qui s’est abstenue d’adopter les engagements avant de connaître officiellement le rectificatif (le 28 mars 2013), était correcte, laissant ainsi entendre que l’action inverse n’aurait pas été correcte.

Finally, if the Court decides to annul the contested decision, the Parliament considers that it would be necessary, in accordance with the second paragraph of Article 264 TFEU, to maintain the effects of the contested decision until it is replaced by a new measure adopted in the prescribed manner.

If that court holds that those decisions had as their object the restriction of competition by harmonising hourly charges for car repairs and that, by the contested vertical agreements, the insurance companies voluntarily confirmed those decisions, which can be assumed where they concluded an agreement directly with that association, the unlawfulness of those decisions would also vitiate those agreements.

However, the Court points out that the exercise of unlimited jurisdiction does not mean that the Courts are obliged to carry out a review of the whole of the contested decision of their own motion, which would involve a new and comprehensive investigation of the file.

The Commission correctly found in point 22 of the contested decision, when applying the first of the two cumulative criteria, that Belgacom could legitimately fear that the applicant would use the subscriber data in order to canvas customers on the telephone directory advertising market, and that this would have affected Belgacom's legal position on that market under the relevant Belgian provisions.
