(e) where no agreement is reached between Quebec and the band as to the selection of replacement land within one hundred and twenty days after service of the expropriation notice (where the band has not contested the right to expropriate) or after the final judgment on the right to expropriate (where the band has contested that right), the compensation to the band shall be in the form of money instead of replacement land, and where the parties cannot agree on the amount of money, which amount must be approved by the electors of the band at a special band meeting or referendum at which at least twenty-five per cent of the electors voted on the matter, section 127 applies.

The Appellant submits that in the contested Judgment the General Court erred in law and wrongly interpreted article 100 (2) of the Financial Regulation (1) and Article 149 of the Implementing Rules by accepting that, since the Appellant's tender did not reach the 70 % threshold, the Commission rightfully did not communicate to the Appellant the relative merits of the winning tenderer.
La partie requérante fait valoir que dans l'arrêt attaqué, le Tribunal a commis une erreur de droit et a interprété de manière erronée l'article 100, paragraphe 2, du règlement financier (1), ainsi que l'article 149 des modalités d'exécution, en admettant que, puisque l'offre de la requérante n'avait pas atteint le seuil de 70 %, la Commission avait, à bon droit, omis de lui communiquer les mérites de l'offre du soumissionnaire retenu.

Secondly, contrary to what the appellant submits, the Court of First Instance did not, at paragraphs 36 and 37 of the contested judgment, reach conclusions that were unsupported by evidence, but carried out an appraisal of the evidence, based in particular on the consideration of the torches in question, which were produced before it.
