As between the Parties to this Protocol which are also Parties to the Convention, Supplementary to the Warsaw Convention, for the Unification of Certain Rules Relating to International Carriage by Air Performed by a Person Other than the Contracting Carrier, signed at Guadalajara on 18 September 1961 (hereinafter referred to as the “Guadalajara Convention”) any reference to the “Warsaw Convention” contained in the Guadalajara Convention shall include reference to the Warsaw Convention as amended at The Hague, 1955, and by Protocol No. 4 of Montreal, 1975, in cases where the carriage under the agreement referred to in Article 1, paragraph (b) of the Guadalajara Convention is governed by this Protocol.

Reiterates once more the importance of the EU Member States working towards the fulfilment of the indivisibility and universality of human rights and supporting the work of the UNHRC in this respect, in particular by ratifying all the international human rights instruments that this body has established; reiterates its regret that no EU Member State has ratified the Convention on the Protection of the Rights of all Migrant Workers and Members of their Families; reiterates, too, its regret that several Member States have not yet adopted and/or ratified the Convention for the Protection of All Persons from Enforced Disappearance or the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and that only two Member States have ratified the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights; reiterates its call for all the Member States to ratify these conventions and protocols, and encourages them to sign and ratify the recent Optional Protocol to the Convention on the Rights of the Child on a communications procedure, which was opened for signature in Geneva, Switzerland, on 28 February 2012; stresses the importance of the Member States submitting their periodic reports to the UN monitoring bodies in a timely manner;

We know that there are new areas which give a certain amount of attention to gender, but we must not forget that, even now, in the European Convention on the Future of Europe, responsible for drawing up amendments to the Treaty, women constitute only 16.6% of the members, whilst they made up 20% of the members of the Convention which drew up the Charter of Fundamental Rights.

In the first reservation, should any Member State sign the Convention, the State in question would declare that the Community rules on jurisdiction would apply if the pollution damage had been caused in the territory of a Member State and the accused were domiciled in a Member State of the EC. Your rapporteur considers that this reservation does no harm, but may unnecessarily complicate the situation. Moreover, there is no corresponding provision in the parallel proposal authorising the Member States to ratify in the interest of the European Community the International Convention on Liability and Compensation for Damage in Connection with the Carriage of Hazardous and Noxious Substances by Sea, 1996 (COM(2001) 674).
Dans la première réserve concernant une éventuelle ratification de la convention par un État membre, celui-ci doit déclarer que les dispositions communautaires relatives à la compétence judiciaire seront appliquées pour autant que le dommage par pollution soit survenu dans une zone géographique d'un État membre de la Communauté européenne et que le défendeur soit domicilié dans un État membre de la Communauté européenne.
