IN-CONTEXT TRANSLATIONS

On 3 December 2010, the States Parties to the Convention adopted the ‘Directive of the States Parties to the Implementation Support Unit’ (‘the ISU’) in which the States Parties agreed that the ISU should provide advice and technical support to States Parties on the implementation and universalisation of the Convention, facilitate communication among the States Parties, and promote communication and information regarding the Convention both towards States not parties to the Convention and to the public.
Le 3 décembre 2010, les États parties à la convention ont adopté la «directive émanant des États parties à l’intention de l’unité d’appui à l’application» (ci-après dénommée «unité d’appui»), dans laquelle les États parties sont convenus que l’unité d’appui devrait leur fournir des conseils et un appui technique concernant la mise en œuvre et l’universalisation de la convention, faciliter la communication entre les États parties, et promouvoir la communication et l’information sur la convention à destination des États non-parties à la convention et du public.

On the other hand, a case involving an EU Member State and a non-Member State which is a State Party to the Convention would be dealt with under the Convention. The Community's relations with other State Parties would therefore be regulated by a harmonised set of rules.

The objective of this Regulation is to contribute to the implementation of the obligations arising under the UNECE Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters, hereinafter referred to as ‘the Aarhus Convention’, by laying down rules to apply the provisions of the Convention to Community institutions and bodies, in particular by:

As rapporteur, I hope Parliament will show more ambition where the Community has authority, as the incorporation of an environmental convention in Community legislation is different from drafting directives based on conventions in other areas, such as banning landmines. While the latter is a static decision, the former should be thought of as a dynamic process.

I should like to thank Mrs Sander-ten Holte once again for her marvellous work and support for the swift introduction of the Montreal Convention into Community law, and she is quite right, since this new incorporation will mean passing on from the international system agreed 72 years ago – which in the end was trying to restrict the airlines’ liability – to another, more modern system which is aiming to do just the opposite: to give a high level of cover to the protection of passengers’ rights.
