The agreement aims to ensure that adequate rules on the protection of intellectual property are applied in all member countries, on the basis of the basic obligations laid down by the World Intellectual Property Organisation (WIPO) in the various conventions on intellectual property rights (the Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works, the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations, and the Washington Treaty on Intellectual Property in Respect of Integrated Circuits).

Given the major technical and economic developments occurring in television broadcasting and the appearance of new communication services in Europe since the Convention was adopted in 1989, and bearing in mind that the European Community had adopted Directive 97/36/EC of the European Parliament and Council of 30 June 1997 amending Directive 89/552/EEC, the Council of Europe saw an urgent need to amend some of the Convention's provisions in order to develop a coherent approach to transfrontier television between the Convention and the revised Directive.

Aspects related to the ongoing merging of conventional broadcasting services with the internet, in particular, need to be dealt with more than hitherto at European level as a result of changing market structures.

3. The provisions of this Article shall be without prejudice to the obligation of individual broadcasters to comply with copyright legislation, including Directive 2001/29/EC , and/or the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations, Rome, 26 October 1961, and the Berne Convention for the Protection of Literary and Artistic Works, 9 September 1886, as subsequently revised and amended.
3. Les dispositions du présent article s'appliquent sans préjudice de l'obligation pour les différents organismes de radiodiffusion télévisuelle de respecter les dispositions sur le droit d'auteur, y compris celles de la directive 2001/29/CE , et/ou de la Convention internationale pour la protection des exécutants, des producteurs de phonogrammes et des organismes de radiodiffusion signée à Rome le 26 octobre 1961 et de la Convention de Berne pour la protection des œuvres littéraires et artistiques du 9 septembre 1886, telle que révisée et modifiée.

(2a) The provisions of this Article shall apply without prejudice to the obligation of individual broadcasters to respect copyright legislation, including Directive 2001/29/EC and/or the Rome Convention ('International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations' of 26th October 1961), and shall not affect that obligation in any way.

The Berne Convention for the protection of literary and artistic works and the International Convention for the protection of performers, producers of phonograms and broadcasting organisations (Rome Convention) lay down only minimum terms of protection of the rights they refer to, leaving the Contracting States free to grant longer terms.
