The applicant claims in that regard that, in tersely confirming in the contested decision that the error in the title of the amending decision of 31 December 2012 had no effect on the content of the decision itself or on the implementation of the programme, the Commission neglected to take into consideration the relevance of the following circumstances: (i) the spending decisions adopted by the Region had to be checked beforehand by the Court of Auditors; (ii) four months had elapsed between the correction being announced and the correction being implemented, without any explanation being provided; (iii) that fact had the potential to arouse the suspicion that the correction to be made was of greater importance than a correction supposedly relating only to the title of the decision of 31 December 2012; and (iv) the Court of Auditors had confirmed that the course of action taken by the Region, which refrained from adopting the commitments until the correction was officially recognised (28 March 2013), was correct, thus giving it to be understood that the opposite course of action would not have been correct.
Il est soutenu à cet égard que, dans la décision attaquée, en affirmant de manière lapidaire que l’erreur contenue dans le titre de la décision modificatrice du 31 décembre 2012 n’a eu aucun effet sur le contenu de la décision elle-même et sur la mise en œuvre du programme, la Commission n’aurait pas tenu compte de la l’importance du fait que les décisions relatives aux frais adoptées par la Région devaient être préalablement contrôlées par la Cour des comptes; que quatre mois se sont écoulés entre l’annonce de la correction et sa réalisation, sans qu’aucune explication ne soit fournie; que ceci a pu susciter le doute que la rectification à effectuer aurait été plus importante que celle annoncée comme se limitant au seul titre de la décision du 31 décembre 2012 et que la Cour des comptes a confirmé que l’action de la Région, qui s’est abstenue d’adopter les engagements avant de connaître officiellement le rectificatif (le 28 mars 2013), était correcte, laissant ainsi entendre que l’action inverse n’aurait pas été correcte.

Even if the Commission had competence to adopt the contested decision and also proceeded, when adopting the contested decision, in accordance with the principle of legal certainty (quod non), according to the Slovak Republic, it did not exercise its competence correctly in this case.

In relation to the financial corrections imposed by the contested Commission implementing decision of 2 May 2013 on excluding from European Union financing certain expenditure incurred by the Member States under the Guarantee Section of the European Agricultural Guidance and Guarantee Fund (EAGGF), the European Agricultural Guarantee Fund (EAGF) and the European Agricultural Fund for Rural Development (EAFRD), notified under document C(2013) 2436 and published at OJ 2013 L 123, in so far as that decision imposes on the Hellenic Republic a financial correction totalling EUR 6 175 094,49 for expenditure incurred by it within the framework of the European Agricultural Fund for Rural Development, in Axis 2, 2007-13, area related measures in the financial years 2009 and 2010 (claim years 2008 and 2009), the Hellenic Republic puts forward the following pleas for annulment:
Concernant les corrections financières prévues par la décision d’exécution de la Commission du 2 mai 2013 écartant du financement de l’Union européenne certaines dépenses effectuées par les États membres au titre du Fonds européen d’orientation et de garantie agricole (FEOGA), section «Garantie», du Fonds européen agricole européen de garantie (FEAGA) et du Fonds européen agricole pour le développement rural (Feader), notifiée sous le no C(2013) 2436 et publiée au JO L 123/2013, dans la mesure où celle-ci impose à la République hellénique une correction financière d’un montant total de 6 175 094,49 euros pour les dépenses effectuées par la République hellénique dans le cadre du Fonds européen agricole pour le développement rural, Axe 2, 2007-2013, mesures liées à la surface, exercices 2009 et 2010 (années de demande 2008 et 2009), la République hellénique fait valoir les moyens d’annulation suivants:

infringement of European Union Law with misinterpretation and misapplication without updating of the guidelines for flat-rate corrections under the old CAP to the new CAP in respect of the distinction of audits as basic and supplementary, insufficient statement of reasons and infringement of the principle of proportionality and the principle of legal certainty, a particular expression of which is the principle of non-retroactivity, since the amounts of the flat-rate corrections related to a distinct set of audit rules, and the contested updating of the abovementioned guidelines took place in June 2006 and consequently could not be applied to the 2006 reporting year.
une violation du droit de l’Union en raison d’une interprétation erronée et d’une application des orientations des corrections forfaitaires de l’ancienne PAC à la nouvelle PAC, sans que celles-ci n’aient été mises à jour, s’agissant de la distinction des contrôles en contrôles-clés et en contrôles secondaires, une insuffisance de motivation et une violation des principes de proportionnalité et de sécurité juridique, dont le principe de non-rétroactivité est une expression spécifique, dans la mesure où les pourcentages des corrections forfaitaires se rapportaient à des régimes de contrôle différents et où la mise à jour évoquée des orientations précitées ayant eu lieu en juin 2006, elle ne pouvait donc pas s’appliquer à l’année de soumission des déclarations 2006.

The Commission contends that the action is inadmissible on the grounds, first, that the applicant failed to identify the contested act correctly and, secondly, that it is virtually certain that both the application for legal aid, lodged on 18 November 2009, and the application initiating proceedings, lodged on 26 March 2010, were brought out of time.

Pleas in law: Infringement of Rule 50 of Commission Regulation No 2868/95 and Article 76(2) of Council Regulation No 207/2009, as the Board of Appeal: (i) based its reasoning and decision on a fact that was not alleged or submitted by the parties, nor referred to in the contested decision, namely that the contested sign will primarily or exclusively be perceived as ‘ULTRA’ with a rounded figurative element; (ii) failed to address important arguments and evidence submitted by the applicant, regarding conceptual similarity, failed to compare correctly the signs with regard to their overall impression, and failed accordingly to apply the global comparison rule, as defined by the Court of Justice; (iii) failed to proceed to an evaluation of likelihood of confusion based on the sole facts that were placed before it; and (iv) failed to take into account in a legally sustainable manner the interdependence of relevant global factors, in particular, the identity or similarity of the goods and services, and the similarity between the signs.
Moyens invoqués: violation de la règle 50 du règlement no 2868/95 de la Commission et de l’article 76, paragraphe 2, du règlement no 207/2009 du Conseil en ce que la chambre de recours: i) a fondé sa décision et son raisonnement sur un fait qui n’a pas été allégué ou soumis par les parties ni mentionné dans la décision, à savoir que le signe litigieux sera principalement ou exclusivement perçu comme «ULTRA» avec un élément figuratif l’entourant; ii) n’a pas examiné des arguments et des éléments de preuve importants soumis par la requérante en ce qui concerne la similitude conceptuelle, n’a pas comparé correctement les signes au regard de l’impression générale et n’a donc pas appliqué la règle de comparaison globale telle que définie par la Cour de justice; iii) n’a pas procédé à une évaluation du risque de confusion sur la base des seuls faits qui lui ont été présentés; et iv) n’a pas tenu compte, d’une manière juridiquement défendable, de l’interdépendance d’éléments globaux pertinents, en particulier de l’identité ou de la similitude des biens et services, ainsi que de la similitude entre les signes.

Accordingly, the Board of Appeal corrected the contested decision by stating that the application for registration pursuant to Article 7(3) of Regulation No 40/94 was also dismissed, on the ground that the body of evidence provided by the applicant was not sufficient to demonstrate distinctiveness acquired through use of the mark applied for.
En conséquence, la chambre de recours a rectifié la décision attaquée en précisant que la demande d’enregistrement en application de l’article 7, paragraphe 3, du règlement n° 40/94 était également rejetée, au motif que les preuves fournies par la requérante n’étaient pas suffisantes pour démontrer le caractère distinctif acquis par l’usage de la marque demandée.
