3. Three measures have already been adopted: a Directive 2010/64/EU of the European Parliament and of the Council on the right to interpretation and translation in criminal proceedings[2] in October 2010 and Directive 2012/13/EU of the European Parliament and of the Council on the right to information in criminal proceedings in May 2012[3], and Directive 2013/48/EU of the European Parliament and of the Council on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty in October 2013.[4] Measures on the protection of vulnerable persons suspected or accused in criminal proceedings are presented as a package with the present initiative, together with a Directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings, which form part of the underlying principles of the right of fair trial.

Consequently, AUCC urges this committee to make the following recommendations in its report on Bill C-10B: First, we recommend that the Minister of Justice issue guidelines or other directives to those administering the criminal justice system specifying that the ``Canadian Council on Animal Care Guide to the Care and Use of Experimental Animals,'' as supplemented by the council's other published guidelines and policies, shall be referred to and considered in the interpretation and application of sections 182.2 and 182.3 of the Criminal Code, specifically in regard to the determination of which activities may constitute criminal conduct in the context of using animals for teaching and scientific research, and when criminal charges should be laid or a prosecution stayed.

Irwin Cotler: With regard to the crisis in Syria: (a) what criteria does the government use to determine (i) whether to intervene, (ii) when to intervene, (iii) the nature and scope of any intervention; (b) who makes the determination in (a) and how; (c) what sources does the government rely upon in determining (a); (d) what legal obligations are considered with respect to (a) and in what ways does the Responsibility to Protect doctrine factor into decision making under (a); (e) in what ways has the government evaluated its obligations under the Responsibility to Protect doctrine with respect to Syria; (f) when were such evaluations done, by whom, and with what outcome; (g) have the criteria by which the government determines its official policy towards the crisis in Syria changed since 2012; (h) when the Minister of Foreign Affairs publicly expressed his support for an indictment of Bashar al-Assad by the International Criminal Court (ICC) in 2012, was this the position of the government and does it remain the position of the government that al-Assad ought to be indicted by the ICC; (j) with respect to Canada’s decision not to sign on to the request of 57 countries made in January, 2013, to ask the Security Council to refer the situation in Syria to the ICC, did Canada support this request; (k) with respect to (j), when, why, how, and by whom were the determinations made in this regard, and when was Canada approached to join in this endeavor and by what means; (l) what criteria were applied in determining whether to support this effort; (m) are there any specific policies or directives within the Department of Foreign Affairs and International Trade that guide decision-making with regard to Canadian intervention in situations of humanitarian crisis; (n) was the decision not to sign the Swiss-led letter asking the United Nations Security Council to refer the situation in Syria to the ICC made by the Minister of Fore ...

Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from the criminal record between Member States (the ‘Framework Decision’ or ‘FD’) aims to address these shortcomings by stipulating that information on any EU citizen’s previous convictions by any criminal court in the EU is available to all Member State courts and law-enforcement authorities for criminal proceedings in the pre-trial and trial stages and the execution of the conviction.By imposing a series of obligations on the convicting Member State and the Member State of nationality, the Framework Decision ensures that each Member State can provide exhaustive and complete information in relation to the criminal records of its nationals upon request by another Member State.
La décision-cadre 2009/315/JAI du Conseil concernant l’organisation et le contenu des échanges d’informations extraites du casier judiciaire entre les États membres (ci-après la «décision-cadre») vise à combler ces lacunes en prévoyant que pour les besoins de procédures pénales, à savoir lors de la phase préalable au procès pénal, lors du procès pénal lui-même ou de la phase d’exécution de la condamnation, toutes les juridictions et autorités de police des États membres ont accès aux informations sur les condamnations antérieures de tout citoyen de l’Union prononcées par une juridiction pénale siégeant dans l’UE. En imposant une série d’obligations à l’État membre de condamnation et à l’État membre de nationalité, cette décision-cadre garantit que chaque État membre fournit, à la demande d’un autre État membre, des informations exhaustives et détaillées concernant le casier judiciaire de ses ressortissants.

This Framework Decision should be without prejudice to the possibility of judicial authorities’ directly requesting and transmitting information from criminal records pursuant to Article 13 in conjunction with Article 15(3), of the European Convention on Mutual Assistance in Criminal Matters and without prejudice to Article 6(1) of the Convention on Mutual Assistance in Criminal Matters between the Member States of the European Union, established by Council Act of 29 May 2000

Under Council of Europe Recommendation No R (84) 10 on criminal records and rehabilitation of convicted persons, the main aim of establishment of criminal records is to inform the authorities responsible for the criminal justice system of the background of a person subject to legal proceedings with a view to adapting the decision to be taken to the individual situation.
Aux termes de la recommandation no R (84) 10 du Conseil de l'Europe sur le casier judiciaire et la réhabilitation des condamnés, l'institution du casier judiciaire vise principalement à informer les autorités responsables du système de justice pénale sur les antécédents du justiciable en vue de faciliter l'individualisation de la décision à prendre.

In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.
