For Joint Committee decisions concerning matters that fall within Member States’ competence, the position to be taken by the European Union and its Member States shall be adopted by the Council, acting by unanimity, on a proposal from the Commission or from Member States, unless a Member State has informed the General Secretariat of the Council within 1 month of the adoption of that position that it can only consent to the decision to be taken by the Joint Committee with the agreement of its legislative bodies.
4. Pour les décisions du comité mixte relatives aux questions relevant de la compétence des États membres, la position à adopter par l’Union européenne et ses États membres est arrêtée par le Conseil, statuant à l’unanimité, sur proposition de la Commission ou d’États membres, sauf si un État membre a informé le secrétariat général du Conseil, dans un délai d’un mois à compter de l’adoption de cette position, qu’il ne peut consentir à l’adoption de la décision par le comité mixte qu’avec l’accord de ses organes législatifs.

4. For Joint Committee decisions concerning matters that fall within Member States’ competence, the position to be taken by the European Union and its Member States shall be adopted by the Council, acting unanimously, on a proposal from the Commission or from Member States, unless a Member State has informed the General Secretariat of the Council within 1 month of the adoption of that position that it can only consent to the decision being taken by the Joint Committee with the agreement of its legislative bodies.
4. They may not depart from Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (8) unless such departure is specifically required for the operation of the Agency and the Commission has given its prior consent.
