TRADUCTIONS EN CONTEXTE

In this judgement, the Court found that the obligations for cargo-handling companies in Spanish ports to register with a 'pool company' and to hold shares in that company and to employ as a priority workers provided by that company run counter of Article 49 of the Treaty on the Functioning of the European Union (TFEU). To date, Spain has not adequately addressed the issues identified in the Court's judgment; therefore, the European Commission has decided to refer Spain to the Court of Justice of the EU for failure to comply with the judgement of 11 December 2014. The Commission invites Spain to rapidly undertake the necessary reforms in order to comply with this judgement; otherwise, the Court may decide to impose financial penalties on Spain.
Dans cet arrêt, la Cour a jugé que l’obligation, pour les entreprises de manutention de marchandises opérant dans les ports espagnols, de s’inscrire auprès d’une société de gestion (SAGEP), de participer à son capital et d’embaucher en priorité les travailleurs qu’elle met à disposition va à l’encontre de l’article 49 du traité sur le fonctionnement de l’Union européenne (TFUE).À ce jour, l’Espagne n’a pas apporté de solution satisfaisante aux problèmes mis en évidence dans l’arrêt de la Cour; c’est pourquoi la Commission européenne a décidé de saisir la Cour de justice de l’UE d’un recours contre l’Espagne pour non-respect de l’arrêt du 11 décembre 2014.La Commission invite l’Espagne à entreprendre rapidement les réformes nécessaires afin de se conformer à cet arrêt; faute de quoi la Cour peut décider d’infliger des sanctions financières à l’Espagne.

1. Judgments handed down by a court whose judgment concerning the opening of proceedings is recognised in accordance with Article 19 and which concern the course and closure of insolvency proceedings, and compositions approved by that court, shall also be recognised with no further formalities.
