In its first plea, the appellant claims that the General Court infringed the principle of equal treatment and fundamental requirements relating to the consistency of judicial decisions in that, in the judgment under appeal, it used the same evidence, without stating any reasons, let alone any convincing reasons, in a contradictory manner against the different applicants, KWS and Shell Nederland Verkoop Maatschappij B.V (‘SNV’, whose action was the subject of the judgment of the General Court of 27 September 2012 in Case T-343/06), whereas, according to the contested decision, KWS and SNV together had the same role in the context of the cartel arrangements.

In those circumstances, the second plea put forward by Freixenet must be upheld and the judgments under appeal set aside, without it being necessary to examine the other grounds of the appeals.
Dans ces conditions, il y a lieu d’accueillir le deuxième moyen soulevé par Freixenet et d’annuler les arrêts attaqués, sans qu’il soit besoin de procéder à l’examen des autres moyens des pourvois.

In the light of the foregoing considerations, the third ground of appeal must be upheld and, on that basis, the judgment under appeal must be set aside, without it being necessary to consider the other two grounds of appeal.

In that connection, although the Civil Service Tribunal, accepted that it was not for it to determine the items of information which the Commission must communicate to the person concerned in order to satisfy its obligation to state reasons, it observed, in particular, that certain additional particulars, such as the intermediate marks for each of the assessment criteria laid down in the notice of competition and the evaluation sheets, could have been sent to Mr Meierhofer with any items of information covered by the secrecy of the selection board’s proceedings blacked out without disclosing either the attitudes adopted by individual members of the selection board or any factors relating to individual or comparative assessments of candidates (paragraphs 50 and 51 of the judgment under appeal).

According to the appellant, contrary to what the General Court found in the judgment under appeal, the First Board of Appeal of OHIM, in the decision that was brought before the General Court, undertook a new appraisal of the distinctive character of the appellant’s trade mark without allowing the appellant to make observations on that new appraisal.

The judgment under appeal furthermore infringes the principle of the rights of the defence and procedural fairness, in deciding that the Office could communicate to the appellant a series of facts, indicating that it would base its refusal decision on those facts and then, after receiving the appellant’s written observations on those facts, decided, at least in part, to disregard them and to found its decision on an evaluation that was factually and conceptually different, without giving the appellant the opportunity to submit any observations.
L'arrêt attaqué violerait également le principe des droits de la défense et de la loyauté procédurale en jugeant que l'Office puisse communiquer à la requérante une série d'éléments de fait en indiquant à celle-ci qu'il entend fonder sa décision de refus sur ces éléments et puis, après avoir reçu les observations écrites de la requérante sur ces éléments, décider de les écarter au moins partiellement et de fonder sa décision sur une appréciation factuellement et conceptuellement différente, sans donner à la requérante la possibilité de faire valoir une quelconque observation.

That requirement is not satisfied by an appeal which, without even including an argument specifically identifying the error of law allegedly vitiating the judgment under appeal, merely repeats or reproduces verbatim the pleas in law and arguments previously submitted to the Court of First Instance.
Ne répond pas à cette exigence le pourvoi qui, sans même comporter une argumentation visant spécifiquement à identifier l'erreur de droit dont serait entaché l'arrêt attaqué, se limite à répéter ou à reproduire textuellement les moyens et les arguments qui ont déjà été présentés devant le Tribunal.

Therefore, the Court of First Instance did not err in law in finding, in paragraphs 58 and 95 of the judgment under appeal, that the Board of Appeal could legitimately have based its finding that the wrapping at issue is not unusual in trade on facts shown by practical experience generally acquired in the marketing of confectionery and likely to be known by anyone, and in particular by consumers of confectionery, without that Board being required to provide concrete examples.

(b) In addition to this well-known situation, and without prejudice to the residual rule in subparagraph (c), subparagraph (b) adds another situation where, on the date on which the judgment on the matrimonial proceedings becomes final, in the sense that such a judgment cannot be the subject of any sort of appeal, proceedings in relation to parental responsibility are still pending and provides that jurisdiction will not cease until a judgment in the responsibility proceedings has become final; in any event in this situation jurisdiction on parental responsibility may be exercised even if the judgment allowing or refusing the application for divorce, legal separation or marriage annulment has become final.
