Even if claims directed against a decision of the Appeals Committee of the European Investment Bank have the effect of bringing before the Union judicature an appraisal report against which an administrative appeal has been lodged, that fact is not, in itself, a reason for the Union court to confine itself to considering the claims against the contested report, or to omit entirely to review the validity of the Appeals Committee’s decision, in so far as the Committee has full power of review authorising it to substitute its assessments for those contained in the report, a power on which the Civil Service Tribunal, on the other hand, cannot rely.

In doing so the Court must not substitute its assessment for that of the competent authority, which considers that the loss of trust has been established, but must confine itself to checking whether the facts referred to by the institution on which its decision was based are substantively accurate.

5. se félicite, à cet égard, de l'intention de la Commission de préciser la distinction entre activités non économiques et économiques dans le cadre des SIEG afin de créer une plus grande sécurité juridique d'ensemble et d'éviter les recours déposés devant la Cour de justice de l'UE et les procédures d'infraction ouvertes par la Commission; invite la Commission à apporter des précisions supplémentaires concernant le quatrième critère cité par la Cour de justice de l'Union européenne dans l'arrêt Altmark et à veiller à ce que la méthode de calcul des bénéfices raisonnables soit suffisamment claire et adaptée à la diversité des SIEG; invite par conséquent la Commission à éviter les listes exhaustives; propose ce faisant que la Commission ne se limite pas à la simple reproduction de la jurisprudence de la Cour de justice, mais qu'elle fournisse plutôt des critères pertinents permettant de comprendre et d'appliquer les notions utilisées; demande à la Commission d'élaborer sa définition de ce que recouvrent de véritables SIEG;

In that context, the General Court holds that the Commission confined itself to taking into account only those differences in rents to establish that there was State aid without having examined the relationship between the rents paid by Olympic Airlines and those available in normal competitive conditions on the market.
