TRADUCTIONS EN CONTEXTE

The Commission's Rule of Law Recommendation sent today to Poland covers four new legislative acts now adopted by thePolish Parliament which in the Commission's assessment will increase the systemic threat to the rule of law: the Law on the Supreme Court, the Law on the National Council for the Judiciary (both 'vetoed' on 24 July by the President of the Republic), the Law on the Ordinary Courts Organisation (signed by the President of the Republic on 25 July and awaiting publication and entry into force); and the Law on the National School of Judiciary (published and in force since 13 July).
La recommandation concernant l'état de droit que la Commission a adressée aujourd'hui à la Pologne concerne quatre actes législatifs désormais adoptés par le parlement polonais qui, selon l'appréciation de la Commission, accroîtront la menace systémique pesant sur l'état de droit. Ces lois concernent respectivement la Cour suprême et le Conseil national de la magistrature (auxquelles le Président de la République a opposé son veto le 24 juillet), l'organisation des juridictions de droit commun (loi signée le 25 juillet par le Président de la République et en attente de publication et d'entrée en vigueur) et l'École nationale de la magistrature (loi publiée et en vigueur depuis le 13 juillet).

Is concerned about the state of relations with Serbia and underlines that good-neighbourly relations are an essential criterion for the aspirations of Serbia as well as of Kosovo and all the other countries in the region to join the EU; while understanding the emotional implications of the aftermath of the 1999 war and understanding that the official recognition of Kosovo is not a feasible political option at the moment for the Belgrade leadership, nevertheless calls on Serbia to be pragmatic on the status issue; to this end, welcomes the signing of the police protocol with EULEX and calls for increased cooperation with the mission; moreover, calls on Serbia to refrain from blocking Kosovo's membership of international organisations and in particular its recent application to join the World Health Organisation; underlines that the conflict also affects regional trade and cooperation under the Central European Free Trade Agreement (CEFTA), harming the economies of the countries in the region; calls on all sides to show a pragmatic approach to allow Kosovo's regional integration; underlines in this regard that the expected advisory opinion of the International Court of Justice on the accordance with international law of the unilateral declaration of independence by the Provisional Institutions of Self-Government of Kosovo should not hinder all parties involved from clearly committing themselves to effective cross-border, regional and local cooperation in the best interests of the whole population in and around Kosovo;
5. s'inquiète de l'état des relations avec la Serbie et souligne que des relations de bon voisinage sont un critère essentiel pour les aspirations d'adhésion à l'Union de la Serbie ainsi que du Kosovo et de tous les autres pays de la région; demande à la Serbie de faire preuve de pragmatisme sur la question du statut, tout en comprenant les implications émotionnelles qu'ont entraînées le conflit de 1999 et le fait que la reconnaissance officielle du Kosovo ne soit pas une option politique réaliste à l'heure actuelle pour les dirigeants de Belgrade; se félicite, à cette fin, de la signature du protocole de coopération policière avec EULEX et se prononce en faveur d'une coopération accrue avec la mission; invite par ailleurs la Serbie à s'abstenir de bloquer l'adhésion du Kosovo à des organisations internationales et en particulier sa récente candidature à l'Organisation mondiale de la santé; souligne que le conflit affecte également les échanges régionaux et la coopération prévus par l'accord de libre-échange centre-européen (ALECE), ce qui porte préjudice à l'économie des pays de la région; invite toutes les parties à faire preuve d'une approche pragmatique pour permettre l'intégration régionale du Kosovo; souligne à cet égard que l'attente de l'avis consultatif de la Cour internationale de justice sur la «conformité au droit international de la déclaration unilatérale d'indépendance des institutions provisoires d'administration autonome du Kosovo» ne doit pas empêcher toutes les parties concernées de s'engager résolument dans une réelle coopération transfrontalière, régionale et locale, dans l'intérêt de toute la population à l'intérieur et autour du Kosovo;

12. Endorses the Court of Auditors" criticisms of support for the electoral process; notes that discussions to clarify the international legal capacity of the OSCE are taking place within that organisation and must be completed before a long-term arrangement such as a framework agreement between the OSCE and the Commission can be signed; notes that future contractual relations between the Commission and the OHR will be governed by the new model contract for international organisations which the Commission has developed; calls on the Commission, following the elections of 11 November 2000 in Bosnia-Herzegovina, to draw up an evaluation report describing experience of the organisation and financing of all elections held since 1996 and to draw the necessary conclusions therefrom and forward the results of this study to the European Parliament;

By its third question, the national court asks essentially whether a contract can be considered to have been concluded during an excursion organised by the trader away from his business premises within the meaning of Article 1(1) of Directive 85/577 if it was signed at a tourist complex of time-share apartments located in a town to which the consumer was invited and which is not the town where the trader has its registered office.
