I have found that judges have been more than tolerant of the comments, the length of comments and the time they take, not because they do not recognize the problem at the trial level but because of their fear of being overturned by a court of appeal which may not have that hands-on day to day experience and not see the problem creeping up.
J'ai remarqué que les juges se sont montrés plus tolérants en ce qui concerne les observations faites, leur durée et le temps mobilisé par l'affaire, non pas parce qu'ils ne reconnaissent pas le problème au niveau de la première instance, mais parce qu'ils craignent que leur décision ne soit renversée par un tribunal d'appel qui ne vit pas directement et quotidiennement ce genre de situation et qui ne voit pas que le problème prend de l'ampleur.
