(93) In order to supplement and amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the identification of the period of time and of the relevant starting or ending dates of the period of time with regard to the admissibility criteria of applications, adjusting the percentages concerning the indicative distribution of funds among the objectives under direct management, the definition of eligible operations and costs for hygiene, health and safety-related investments and investments concerning working conditions, on board or in individual equipment, the definition of eligible costs of operations to protect and restore marine biodiversity and ecosystems in the framework of sustainable fishing activities, the definition of costs eligible for support with regard to investments in equipment or on board aimed at reducing the emission of pollutants or green-house gases and increasing the energy efficiency of fishing vessels, the definition of the criteria for calculation of the additional costs resulting from the specific handicaps of outermost regions, the definition of the cases of non-compliance by Member States which can trigger interruption of the payment deadline or suspension of payments, the definition of the criteria for establishing the level of financial correction to be applied and the criteria for applying flat rates or extrapolated financial corrections and the definition of the content and construction of the common monitoring and evaluation system.
(93) Afin de compléter et de modifier certains éléments non essentiels du présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne en ce qui concerne la détermination de la période et de la date de début ou de fin pertinente de la période en rapport avec des critères d'éligibilité des demandes, en ajustant les pourcentages concernant la répartition indicative des fonds entre les objectifs relevant de la gestion directe, la définition des opérations éligibles et les coûts associés aux investissements en matière d'hygiène, de santé et de sécurité concernant les conditions de travail, à bord ou pour les équipements individuels, la définition des coûts éligibles liés aux opérations visant à protéger et à rétablir la biodiversité et les écosystèmes marins dans le cadre d'activités de pêche durables, la définition de coûts éligibles au soutien en ce qui concerne les investissements en matière d'équipements ou à bord visant à réduire l'émission de polluants ou de gaz à effet de serre et à augmenter l'efficacité énergétique des navires de pêche, la définition des critères de calcul des coûts supplémentaires résultant des handicaps spécifiques des régions ultrapériphériques, la définition des cas de manquement par les États membres qui peuvent entraîner l'interruption du délai de paiement ou la suspension des paiements, la définition des critères de détermination du niveau de correction financière à appliquer et des critères relatifs à l'application de corrections financières forfaitaires ou extrapolées, et la définition du contenu et de la construction d'un cadre commun pour le système de suivi et d'évaluation.

(66) The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in order to determine the type of contributions to the Fund and the matters for which contributions are due, the manner in which the amount of the contributions is calculated and the way in which they are to be paid; determine the annual contributions necessary to cover the administrative expenditure of the Board before it becomes fully operational; specify registration, accounting, reporting and other rules necessary to ensure that the contributions are fully and timely paid; determine the contribution system for institutions that have been authorized to operate after the Fund has reached its target level; determine the criteria for the spreading out in time of the contributions; determine the circumstances under which the payment of contributions may be advanced; determine the criteria for determining the number of years by which the initial period for reaching the target fund level can be extended; determine the criteria for establishing the annual contributions when the available financial means of the Fund diminishes below its target level after the initial period ; determine the measures to specify the circumstances and modalities under which ex- post contributions, may be temporarily suspended for individual institutions.

The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in order to determine the rules for the calculation of the interest rate to be applied in the event of a decision on the recovery of misused amounts from the Fund and to guarantee the rights to good administration and of access to documents of beneficiaries in procedures in respect of such a recovery; determine the type of contributions to the Fund and the matters for which contributions are due, and the manner in which the amount of the contributions is calculated and the way in which they are to be paid; specify registration, accounting, reporting and other rules necessary to ensure that the contributions are paid fully and in a timely manner; determine the annual contributions necessary to cover the administrative expenditure of the Board before it becomes fully operational; determine the contribution system for institutions that have been authorised to operate after the Fund has reached its target level; determine the criteria for the spreading out in time of the contributions; determine the criteria for determining the number of years by which the initial period for reaching the target level can be extended; determine the criteria for establishing the annual contributions when the available financial means of the Fund diminishes below its target level after the initial period; determine the measures to specify the circumstances and conditions under which ex-post contributions may be temporarily deferred for individual institutions; and determine the detailed rules for the administration of the Fund and general principles and criteria for its investment strategy.

(13a) In order to guarantee the protection of the rights of farmers, the power to adopt certain acts should be delegated to the Commission in respect of criteria to establish the cases where a farmer's agricultural area is to be considered as mainly an area naturally kept in a state suitable for grazing or cultivation, criteria to establish the distinction between receipts resulting from agricultural and non-agricultural activities and the amount of direct payments relevant for applying the marginality test, and criteria to be met by farmers in order to prove that their agricultural activity is not marginal.
(13 bis) Afin de garantir la protection des droits des agriculteurs, il y a lieu de déléguer à la Commission le pouvoir d'adopter certains actes relatifs aux critères permettant de déterminer les cas dans lesquels les surfaces agricoles d'un agriculteur doivent être considérées comme étant principalement des surfaces naturellement conservées dans un état qui les rende adaptées au pâturage ou à la culture, aux critères permettant d'établir une distinction entre les recettes provenant des activités agricoles et des activités non agricoles et de fixer le montant des paiements nécessaire aux fins de l'application du principe de marginalité, ainsi que les critères à remplir par les agriculteurs pour être en mesure de démontrer que leur activité agricole ne revêt pas un caractère marginal.

6. The Commission shall be empowered, by means of delegated acts in accordance with Article 142, to lay down detailed rules concerning the criteria for determining serious deficiencies in the functioning of management and control systems, including the main types of serious deficiencies, the criteria for establishing the level of financial correction to be applied and the criteria for applying flat rates or extrapolated financial corrections .
6. Le pouvoir est conféré à la Commission d'adopter des actes délégués en conformité avec l'article 142 définissant des règles détaillées concernant les critères permettant de déterminer les cas considérés comme des défaillances graves dans le fonctionnement des systèmes de gestion et de contrôle, y compris les principaux types de défaillances graves, les critères concernant la fixation du niveau de correction financière à appliquer et les critères concernant l'application des corrections financières forfaitaires ou extrapolées .

In order to provide for supplementary rules, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the identification of family members, siblings or relatives of an unaccompanied minor; the criteria for establishing the existence of proven family links; the criteria for assessing the capacity of a relative to take care of an unaccompanied minor, including where family members, siblings or relatives of the unaccompanied minor stay in more than one Member State; the elements for assessing a dependency link; the criteria for assessing the capacity of a person to take care of a dependent person and the elements to be taken into account in order to assess the inability to travel for a significant period of time.
Afin d’établir des règles supplémentaires, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne l’identification des membres de la famille, des frères ou sœurs ou des proches d’un mineur non accompagné; les critères permettant d’établir l’existence de liens familiaux avérés; les critères permettant d’évaluer la capacité d’un proche à s’occuper d’un mineur non accompagné, y compris lorsque les membres de la famille, les frères ou sœurs ou des proches du mineur non accompagné résident dans plusieurs États membres; les éléments permettant d’évaluer un lien de dépendance; les critères permettant d’évaluer la capacité d’une personne à s’occuper d’une personne à charge et les éléments à prendre en compte afin d’évaluer l’incapacité à se déplacer pendant un temps assez long.

The amounts resulting from the application of 5 percentage points corresponding to the modulation reductions determined in Regulation (EC) No 1782/2003 should be allocated amongst Member States according to the same criteria established under that Regulation, that is in accordance with objective criteria, while establishing that a certain percentage of the amounts is to remain in the Member States where they were generated.
Il y a lieu de répartir, entre les États membres, les montants provenant de l'application des 5 % de réduction prévus par le règlement (CE) no 1782/2003 au titre de la modulation, sur la base des mêmes critères que ceux qui sont établis par ledit règlement, à savoir des critères objectifs, tout en décidant qu'un pourcentage donné des montants doit rester dans les États membres où ils ont été générés.

(7) It is appropriate that, for a limited period of not more than 12 months, both the new criteria established by this Decision and the criteria previously established by Decision 98/483/EC, are valid concurrently, in order to allow sufficient time for companies that have been awarded the eco-label for their products prior to the adoption of this new Decision to adapt these products to comply with the new criteria.
(7) Il convient que, pour une période limitée n'excédant pas douze mois, les nouveaux critères établis par la présente décision et les critères antérieurement établis par la décision 98/483/CE soient valables simultanément, afin de laisser aux sociétés dont les produits ont obtenu le label écologique avant l'adoption de la présente décision un délai suffisant pour mettre ces produits en conformité avec les nouveaux critères.
