3. Supports the Commission’s recommendations to streamline the use of existing instruments and channels (such as the default use of the Europol channel and the creation of national integrated Single Point of Contacts) and to improve training and awareness on cross-border information exchange; is disappointed, however, that the Commission did not provide for a more ambitious, future-oriented vision, as was called for in the Stockholm Programme and the Internal Security Strategy, that could be a starting point for a political debate on how to shape and to optimise law enforcement data sharing in the EU, while guaranteeing a robust level of data protection and privacy; strongly encourages the Commission to come forward with this vision, setting a well-tailored framework for EU law enforcement information exchange based on principles such as necessity, quality, proportionality, efficiency and accountability and including a proper assessment of the availability principle and the concept of cross-matching;

The proposed regulations on access to the network in cross-border electricity exchange and common principles on the internal energy market should promote full synchronisation of the networks of the countries of old Europe and the new countries.

The evaluation of the results of data exchange should not merely concern technical and administrative aspects of the exchange, but should include an assessment of the consequences of big differences in criteria for and techniques in collecting and storing DNA in the member states, and the assessment should also address proportionality and effectiveness, since the added value of this large extension of cross-border data exchange has to be proven feasible against the results.

At the European Council’s request, the Commission presented in 2005 a proposal for an instrument regulating the exchange of information under the principle of availability.[34] Instead of endorsing this proposal, the Council adopted in 2006 the Swedish initiative , which streamlines the sharing between Member States of any existing information or criminal intelligence that might be necessary for a criminal investigation or criminal intelligence operation.[35] This instrument is rooted in the policy principle of ‘equivalent access,’ according to which the conditions applicable to cross-border data exchange should be no stricter than those regulating domestic access.
À la demande du Conseil européen, la Commission a présenté, en 2005, une proposition d’instrument régissant l’échange d’informations en vertu du principe de disponibilité[34]. An important part of the Commission’s 1992 Programme, which established the internal market, concerned the abolition of all checks and formalities in respect of goods moving within the Community.[26] The elimination of such procedures at internal borders heightened the risk of fraud, which made it necessary for Member States to establish, on the one hand, a mechanism of mutual administrative assistance to assist in preventing, investigating and prosecuting operations in breach of Community customs and agriculture legislation and, on the other hand, customs cooperation aiming to enable the detection and prosecution of violations of national customs provisions, notably by enhancing cross-border information exchange.
