5. Where the Court, in a final decision, revokes a patent, either entirely or partly, it shall send a copy of the decision to the European Patent Office and, with respect to a European patent, to the national patent office of any Contracting Member State concerned.

Chapter I on the Community Patent Court contains two major elements. Articles 1 to 3 of the Decision contain provisions which set up the Community Patent Court, determine the EC Treaty provisions to be applied to the Community Patent Court and provide a legal basis for an annex to the Protocol on the Statute of the Court of Justice containing the Statute provisions as applied by the Community Patent Court. Article 4 contains the special provisions relating to the Community Patent Court which are to be annexed to the Protocol on the Statute of the Court of Justice (hereinafter "Statute").

(4) In accordance with Council Decision 2011/167/EU authorising enhanced cooperation in the area of the creation of unitary patent protection, the translation arrangements for European patents with unitary effect should be simple and cost-effective and correspond to those provided for in the proposal for a Council Regulation on the translation arrangements for the European Union patent[28], presented by the Commission on 30 June 2010, combined with the elements of compromise proposed by the Presidency in November 2010 that had wide support in the Council[29].
(4) Conformément à la décision 2011/167 du Conseil autorisant une coopération renforcée dans le domaine de la création d’une protection par brevet unitaire, les modalités de traduction des brevets européens à effet unitaire devraient être simples, présenter un bon rapport coût-efficacité et correspondre à celles prévues dans la proposition de règlement du Conseil sur les dispositions relatives à la traduction pour le brevet de l’Union européenne[28], présentée par la Commission le 30 juin 2010, et aux éléments de compromis proposés par la présidence en novembre 2010 et largement soutenus par le Conseil[29].

The Community Patent Court would thus have jurisdiction for the subject matter laid down in Article 1 of the Commission proposal for such a Council Decision, namely for disputes relating to the infringement or the validity of a Community patent and a Community supplementary protection certificate, the use of the invention after the publication of the Community patent application, the right based on prior use of the invention, interim and evidence-protection measures in the subject matters conferred, damages and compensation incurred in the situations referred to above and orders of a penalty payment in case of non-compliance with a decision or order constituting an obligation to act or to abstain from an act.
Le Tribunal sera donc compétent dans le domaine spécifié à l'article premier de ladite proposition de décision du Conseil, à savoir les litiges relatifs à la contrefaçon et la validité de brevets communautaires ou de certificats complémentaires de protection communautaire, à l'utilisation de l'invention après la publication de la demande de brevet communautaire, aux droits fondés sur une utilisation antérieure de l'invention, aux mesures provisoires et de protection des preuves dans cette matière et aux demandes en dommages-intérêts dans les situations susmentionnées et dans les ordonnances d'astreinte en cas de non-observation d'une décision ou d'une ordonnance constituant une obligation d'agir ou de s'abstenir d'agir.
