The Commission has subscribed to this interpretation from the outset and considers that the solution we are working towards respects the basic structure of the Commission’s initial proposal, which is to, “define a terrorist offence on the basis of the identification of an objective factor: the terrorist act, accompanied by the identification of a subjective element: a terrorist motivation under the terms of the proposal”. This is the text currently under consideration by the Council. At the same time, the solution also provides more detail on allowing the requirements that must be met for the offence included in the positive list to be considered a terrorist offence, to be identified in legislation itself. We are, therefore, in favour of improving the definition contained in the text currently being studied by the Council.
D’emblée, la Commission a souscrit à cette interprétation, elle considère que la solution vers laquelle nous nous dirigeons est une solution qui, en respectant la structure essentielle de la proposition initiale de la Commission, à savoir la "définition de l’infraction terroriste sur la base de l’identification d’un élément objectif, l’acte terroriste, accompagné par l’identification d’un élément subjectif, la motivation terroriste selon les termes de la proposition," - tel est le texte actuellement étudié par le Conseil - permet que, de manière plus détaillée, les conditions à remplir pour que l’infraction soit considérée comme une infraction terroriste soient identifiées dans la règle juridique elle-même. C’est pourquoi nous nous associons à l’amélioration de la définition contenue dans le texte analysé par le Conseil.
