Indeed, as the use of detection technologies will usually mean an intrusion of the fundamental rights to private life and protection of personal data, any intrusion of fundamental rights has to be in compliance with the European Convention on Fundamental Rights; in particular, it must be in accordance with the law and necessary in a democratic society to protect an important public interest and must be in proportion to the public interest pursued.
