The aim of this Agreement is to apply the provisions of Council Regulation (EC) No 343/2003 of 18 February 2003 on the criteria and mechanisms for establishing the Member State responsible for examining a request for asylum lodged in Denmark or any other Member State of the European Union (Dublin II Regulation), Council Regulation (EC) No 2725/2000 of 11 December 2000 concerning the establishment of Eurodac for the comparison of fingerprints for the effective application of the Dublin Convention (Eurodac Regulation) and their implementing measures to the relation between the Community and Denmark, in accordance with Article 2(1) and 2(2).

Le présent accord vise à appliquer les dispositions du règlement (CE) no 343/2003 du Conseil, du 18 février 2003, établissant les critères et mécanismes de détermination de l’État membre responsable de l’examen d’une demande d’asile présentée au Danemark ou dans tout autre État membre de l’Union européenne («règlement Dublin II»), du règlement (CE) no 2725/2000 du Conseil, du 11 décembre 2000, concernant la création du système «Eurodac» pour la comparaison des empreintes digitales aux fins de l’application efficace de la convention de Dublin («règlement Eurodac») et de leurs mesures d’application aux rapports entre la Communauté et le Danemark conformément à l’article 2, paragraphes 1 et 2.

REFERRING to the provision that, pursuant to Article 68(3) of the Treaty establishing the European Community, the Council of the European Union, the European Commission and the Member States may request the Court of Justice of the European Communities to give a ruling on the interpretation of acts of the institutions of the Community based on Title IV of the Treaty, including the interpretation of this Agreement, and the circumstance that this provision shall not be binding upon or applicable in Denmark, according to the Protocol on the position of Denmark.

In the event that Denmark requests a further extension of the derogation measure beyond 2017, it should submit a report to the Commission together with the extension request.

For example, Denmark requested the inclusion of chiropodists (fodterapeuter) and pharmacy assistants (apoteksassistenter) in Appendix C. The processing of the request, in particular an enquiry by experts, was so lengthy that by the time the Commission decision had been reached, in 1997 - negative, in the event -the legal basis for the training of chiropodists had been changed, and inclusion in Annex C was no longer necessary. In any case, the Commission decision took no account of the changed law.
