1 By its appeal, Develey Holding GmbH Co. Beteiligungs KG (‘Develey’) seeks to have set aside the judgment of the Court of First Instance of the European Communities of 15 March 2006 in Case T‑129/04 Develey v OHIM(Shape of a plastic bottle) [2006] ECR II‑811 (‘the judgment under appeal’), which dismissed Develey’s action for annulment of the decision of the Second Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) (‘OHIM’) of 20 January 2004 refusing registration of a three‑dimensional mark (‘the contested decision’).
Par son pourvoi, la société Develey Holding GmbH Co. Beteiligungs KG (ci‑après «Develey») demande l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 15 mars 2006, Develey/OHMI (Forme d’une bouteille en plastique) (T‑129/04, Rec. p. II‑811, ci-après l’«arrêt attaqué»), par lequel ce dernier a rejeté son recours tendant à l’annulation de la décision de la deuxième chambre de recours de l’Office de l’harmonisation dans le marché intérieur (marques, dessins et modèles) (OHMI), du 20 janvier 2004 refusant l’enregistrement d’une marque tridimensionnelle (ci-après la «décision litigieuse»).
