In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission in order: to specify the format and code of the common data requirements for the purpose of the exchange of information between the customs authorities and between economic operators and customs authorities and the storage of such information and the procedural rules on the exchange and storage of information which can be made by means other than electronic data-processing techniques; to adopt decisions allowing one or several Member States to use means for the exchange and storage of information other than electronic data-processing techniques; to specify the customs authority which is responsible for the registration of economic operators and of other persons; to specify the technical arrangements for developing, maintaining and employing electronic systems; to specify the procedural rules on the conferral and proving of the entitlement for a customs representative to provide services in a Member State other than the one where he or she is established; the procedural rules on the submission and acceptance of an application for a decision relating to the application of the customs legislation, and on the taking and the monitoring of such a decision; the procedural rules on the annulment, revocation and amendment of favourable decisions; the procedural rules on the use of a decision relating to binding information after it ceases to be valid or is revoked; the procedural rules on the notification to the customs authorities that the taking of such decisions is suspended and on the withdrawal of such suspension; to adopt decisions requesting Member States to revoke decisions relating to binding information; to adopt the modalities for the application of the criteria for the granting of the status of authorised economic operator; to adopt measures to ensure uniform application of customs controls, including the exchange o ...

It follows that, as regards the requests for information and documents, both the implied decision not to send the information requested concerning test (b), which took place on 14 June 2009 (‘the decision not to send written test (b)’), and the implied decision not to send the information requested concerning test (c), which was contained in the letter of 23 July 2009 (‘the decision not to send written test (c)’), in so far as that letter does not address the question of sending the information requested, are acts adversely affecting the applicant.

However, in accordance with Council Framework Decision 2006/960/JHA of 18 December 2006 on simplifying the exchange of information and intelligence between law enforcement authorities of the Member States of the European Union (8), information contained in the VIS can be provided to the United Kingdom and Ireland by the competent authorities of the Member States whose designated authorities have access to the VIS pursuant to this Decision. Information held in the national visa registers of the United Kingdom and Ireland can be provided to the competent law enforcement authorities of the other Member States.
Toutefois, conformément à la décision-cadre 2006/960/JAI du Conseil du 18 décembre 2006 relative à la simplification de l'échange d'informations et de renseignements entre les services répressifs des États membres de l'Union européenne (8), les informations contenues dans le VIS peuvent être communiquées au Royaume-Uni et à l'Irlande par les autorités compétentes des États membres dont les autorités désignées ont accès au VIS en vertu de la présente décision, et les informations tenues dans les registres nationaux relatifs aux visas du Royaume-Uni et de l'Irlande peuvent être transmises aux services répressifs compétents des autres États membres.

There were key information gaps on significant areas of EIA including: the number of EIAs that have taken place, screening decisions, quality of environmental information, public participation, salami-slicing, cumulative impacts, health impacts, biodiversity, and decision making - including delays between the consideration of the environmental information and the decision and between the decision and implementation.

In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.
En 2006 et 2007, la Commission a présenté un ensemble complet de mesures législatives composé de trois instruments: la décision-cadre 2008/675/JAI du Conseil obligeant les États membres à prendre en compte les décisions de condamnation antérieures à l’occasion d’une nouvelle procédure pénale; la décision-cadre 2009/315/JAI du Conseil concernant l'organisation et le contenu des échanges d'informations extraites des casiers judiciaires; et la décision 2009/316/JAI du Conseil relative à la création de l’ECRIS comme moyen technique d’échanger des informations extraites des casiers judiciaires[47]. Devant être mises en œuvre au plus tard en avril 2012, les décisions-cadres 2009/315/JAI et 2009/316/JAI du Conseil visent à définir les procédures selon lesquelles un État membre prononçant une condamnation doit transmettre les informations relatives à une nouvelle condamnation à l’État membre ou aux États membres de nationalité de la personne condamnée, à préciser les obligations en matière de stockage et à arrêter un cadre pour un système informatisé d’échange d’informations.
