In accordance with the exception from the right to public access to documents set out in Article 4(2) of Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (2) certain information contained in the application for derogation should be exempted from public access where disclosure of this information would undermine the protection of commercial interest, in particular information on the applicant’s product planning, expected costs and impacts on the profitability of the company.

The Court rejects that argument and takes the view that, where disclosure of a document undermines the public interest, the ECB is obliged to refuse access, and no weighing up of that public interest against an ‘overriding public interest’ is provided for by EU law.

However, the Access to Documents Regulation provides that institutions of the Union are to refuse access to a document where disclosure would risk undermining the protection of the purposes of inspections and investigations.

There are only a few mandatory exceptions to the right of public access, notably where disclosure of a document could undermine the public interest as regards public security, defence and military matters, international relations or the financial, monetary or economic policy or the privacy and integrity of individuals.
