TRADUCTIONS EN CONTEXTE

1. All Indian Reserves in the Province of Ontario heretofore or hereafter set aside, shall be administered by the Dominion of Canada for the benefit of the band or bands of Indians to which each may have been or may be allotted; portions thereof may, upon their surrender for the purpose by the said band or bands, be sold, leased or otherwise disposed of by letters patent under the Great Seal of Canada, or otherwise under the direction of the Government of Canada, and the proceeds of such sale, lease or other disposition applied for the benefit of such band or bands, provided, however, that in the event of the band or bands to which any such Reserve has been allotted becoming extinct, or if, for any other reason, such Reserve, or any portion thereof is declared by the Superintendent General of Indian Affairs to be no longer required for the benefit of the said band or bands, the same shall thereafter be administered by, and for the benefit of, the Province of Ontario, and any balance of the proceeds of the sale or other disposition of any portion thereof then remaining under the control of the Dominion of Canada shall, so far as the same is not still required to be applied for the benefit of the said band or bands of Indians, be paid to the Province of Ontario, together with accrued unexpended simple interest thereon.

Toutes réserves des sauvages mises de côté jusqu’à présent ou à l’avenir dans la province d’Ontario, sont administrées par le Dominion du Canada au bénéfice de la ou des bandes de sauvages à laquelle ou auxquelles chacune peut avoir été ou être attribuée; des parties de ces réserves peuvent, lors de leur abandon pour cette fin par la ou lesdites bandes être vendues, données à bail ou autrement aliénées par lettres patentes sous le grand sceau du Canada, ou autrement sous la direction du gouvernement du Canada, et le produit de cette vente, location ou autre aliénation peut être appliqué au bénéfice de cette ou ces bandes : Toutefois, advenant l’extinction de la ou des bandes à laquelle ou auxquelles une telle réserve avait été attribuée, ou que, pour toute autre raison, cette réserve ou toute partie de réserve soit, par le Surintendant général des affaires des Sauvages, déclarée non requise désormais pour le bénéfice de ladite ou desdites bandes, elle est dans la suite administrée par la province d’Ontario et pour son bénéfice, et tout solde du produit de la vente ou autre aliénation de l’une de ses parties restée alors sous le contrôle du Dominion du Canada, dans la mesure où il n’est pas requis davantage pour le bénéfice de ladite ou desdites bandes de sauvages, est versé à la province d’Ontario, ainsi que l’intérêt simple accumulé et non dépensé de ce solde.

WHEREAS by Quit Claim dated March 12, 1907, the Stoney Indian Band surrendered to His Majesty certain tracts of land situated in the Stoney Indian Reserve in the Province of Alberta containing one thousand (1,000) acres more or less adjacent to Horseshoe Falls, partly on the north side and partly on the south side of the Bow River, in trust to sell the same to such person or persons and upon such terms as the Government of the Dominion of Canada might deem most conducive to the Band’s welfare and upon further condition that all moneys received from the sale thereof were to be disposed of as therein provided, it being further stipulated that the land was to be sold at the rate of ten dollars per acre on conditions which included the Band agreeing to release their interest in the water power at the Horseshoe Falls on the payment of the sum of $1,500 per annum, in advance, to be placed in the hands of the Superintendent General of Indian Affairs for the benefit of the Band;
Attendu que, selon la renonciation en date du 12 mars 1907, la bande indienne de Stoney a cédé à Sa Majesté certaines terres situées dans la réserve indienne de Stoney, dans la province d’Alberta, d’une superficie de 1 000 acres, plus ou moins adjacentes aux chutes Horseshoe, en partie du côté nord et en partie du côté sud de la rivière Bow, en fiducie pour vendre ces terres aux personnes et aux conditions que le gouvernement du Dominion du Canada trouve les plus favorables au bien-être de la bande et à la condition supplémentaire que tout l’argent provenant de la vente de ces terres soit utilisé comme prévu à cet égard. And Whereas the surrender of the whole or some portion of a Reserve by the band of Indians to whom the same was allotted has, in respect of certain Reserves in the Provinces of Ontario and Quebec, been under consideration in certain appeals to the Judicial Committee of the Privy Council, and the respective rights of the Dominion of Canada and the Province of Ontario, upon such surrenders being made, depend upon the law as declared by the Judicial Committee of the Privy Council and otherwise affecting the Reserve in question, and upon the circumstances under which it was set off;
