The Investors' Board shall act by consensus and in no circumstance shall undermine any decision taken on the implementation of the overall strategy of the [COSME Financial Instruments] [AND/OR] [H2020 Financial Instruments] by the relevant steering committee foreseen in the respective Delegation Agreement[s].

1. A Member State requesting or receiving financial assistance from one or several other States, the IMF, the EFSF, the EFSM or the ESM shall prepare in agreement with the Commission - acting in liaison with the ECB and, where appropriate, with the IMF - a draft macroeconomic adjustment programme which shall build on and substitute any economic partnership programmes under Regulation (EU) No ./2012 [on common provisions for monitoring and assessing draft budgetary plans and ensuring the correction of excessive deficit of the Member States in the euro area], which shall also include annual budgetary target. The draft macroeconomic adjustment programme shall addresses the specific risks emanating from that Member State for the financial stability of the euro area and shall aim at rapidly re-establishing a sound and sustainable economic and financial situation and restoring its capacity to finance itself fully on the financial markets. The draft macroeconomic adjustment programme shall be based on the assessment of the sustainability of the government debt and shall take due account of the recommendations addressed to the Member State concerned under Articles 121, 126, 136 and/or 148 TFEU - and its actions to comply with them - while aiming at broadening, strengthening and deepening the required policy measures. The draft macroeconomic adjustment programme shall respect the practices and institutions for wage formation and industrial relations in the Union and shall, where possible, take into account the national reform programme of the Member State concerned in the context of the Union strategy for growth and jobs. The draft macroeconomic adjustment programme shall fully observe Article 151 TFEU and Article 28 of the Charter of Fundamental Rights of the European Union.

Le projet de programme d'ajustement macroéconomique remédie aux risques spécifiques que l'État membre en question fait peser sur la stabilité de la zone euro et vise à rétablir rapidement une situation économique et financière saine et durable ainsi que sa capacité à se financer intégralement sur les marchés financiers. Ce projet de programme d'ajustement macroéconomique est basé sur l'évaluation de la soutenabilité de la dette publique et tient dûment compte des recommandations adressées à l'État membre concerné au titre des articles 121, 126, 136 et/ou 148 du traité – et des actions entreprises pour s'y conformer – tout en visant à élargir, renforcer et approfondir les mesures requises. 4. Notes that the Treaty of Lisbon incorporates the institutionalisation of the Interinstitutional Agreement (IIA) and the Multi-annual Financial Framework (MFF), which means that both financial agreements will have to be put into legislative acts, using a special decision-making procedure for the MFF; points out that, if Parliament and the Council fail to agree on a new MFF, the current one will be extended until such an agreement is reached;

The Commission shall be empowered to adopt delegated acts in accordance with Article 210 concerning detailed rules on financial instruments, including the selection of entities entrusted with the implementation of financial instruments, the content of delegation agreements, management costs and fees, the specific rules for fiduciary accounts, the direct implementation of the financial instruments and the selection of managers, of financial intermediaries and of final recipients.

However, by virtue of point 14 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (IIA) , no act adopted under the codecision procedure by the European Parliament and the Council nor any act adopted by the Council which involves exceeding the appropriations available in the general budget of the European Union or the allocations available in the financial framework should be implemented in financial terms until the general budget of the European Union has been amended and, if necessary, the financial framework has been appropriately revised in accordance with the relevant procedure for each of these cases .
