Considers that the redundancies in Duferco and NLMK are linked to major structural changes in world trade patterns due to globalisation, given that the steel production sector has undergone serious economic disruption, in particular a rapid decline in the EU’s market share; furthermore, as a consequence of the economic crisis and a relative increase in production costs, world trade patterns were worsened by other factors such as a decline in demand for steel in the automotive and construction sector;

However, this risk of a loss for SWS has been offset in the present case by a guarantee from the majority private shareholder, Duferco International Investment Holding Ltd. The latter, which is the holding company for the Duferco group, has provided a joint and several guarantee to the tune of 75% of all sums due (principal and interest) in the event of Duferco Clabecq becoming insolvent.
