It is not just that there are two legal bases for aid to Bosnia and Herzegovina, i.e. the Phare Regulation and Council Regulation 1628/96, plus a separate regulation for ECHO: the main problem is that the 1996 Council Regulation relating to the three budget headings 'Reconstruction', 'Refugee return' and 'Europe for Sarajevo', which have been grouped together in a single programme under the Bosnian word for reconstruction, 'Obnova', is based on the incorrect assumption that aid projects in Bosnia and Herzegovina could be implemented, as is customary for EU funds and in accordance with the Financial Regulation, with a central government and an effective administration and that preliminary development work and evaluation, technical preparations, the award of contracts and monitoring could be managed centrally by the Commission in Brussels.
