However, in this particular case it was considered that the licence had certain effects which were incompatible with the conditions laid down in Article 85(3) of the EEC Treaty, notably because there was no effective competition on the market in question, and accordingly, the necessary conditions for an exemption were not fulfilled. Thus, if Tetra Pak had not acceded to Commission pressure to renounce all claims to the exclusivity in question, the Commission would have withdrawn for the first time the benefit of one of its block exemption Regulations and would have declared that the exclusive licence in question infringed Article 85(1). As a consequence of the Commission's action in this case the British Technology Group has stated that it is willing to enter into negotiations with Elopak for a non-exclusive licence to enable Elopak to exploit the new sterilisation technology (1) Commission Regulation 2349/84, see IP (84) 270

The Commission had initiated the procedure provided for in Article 93(2) of the EEC Treaty in respect of aid in the fertilizer industry, paid as part of the activities of SYNEL (it was such aid that created the debts that are to be written off), because, on the basis of its information at the time, and notably the intensity of competition and the volume of intra-Community trade in the fertilizer industry, it thought that the aid might be incompatible with Article 92.

It has also decided to examine whether the long-term coal supply contracts to electricity generators, notably Germany's "Jahrhundertvertrag" for 1989-95, are compatible with the rules on competition in the EEC Treaty.
Quant au contrat de fournitures à long terme de charbon aux producteurs d'électricité, la Commission a décidé d'examiner la compatibilité de tels contrats existant dans plusieurs Etats membres, et notamment du "Jahrhundertvertrag" (contrat de fourniture portant sur la période 1980-1995), avec les règles de concurrence du traité CEE.

As a result of the substantial amendments made to the draft order, application of the provisions that gave rise to the initiation of proceedings will be restricted to the granting of aid that may be deemed compatible with the common market either because it represents the counterpart to Community aid or because it fulfils the conditions laid down by the Community frameworks on national aid, notably the framework on aid for small and medium-sized businesses, or because it relates to participation in important projects of common European interest within the meaning of Article 92(3)(b) of the EEC Treaty.
