On a proper construction of the EC Treaty, having regard to the provisions of Directive 2001/77/EC of the European Parliament and of the Council of 27 September 2001 on the promotion of electricity produced from renewable energy sources in the internal electricity market, the European Community enjoys exclusive external competence precluding a provision of national law, such as that at issue in the main proceedings, which provides for the grant of exemption from the obligation to purchase green certificates owing to the introduction, onto the national consumer market, of electricity imported from a third State, by means of the prior conclusion, between the Member State and third State concerned, of an agreement under which the electricity thus imported is guaranteed as having been produced from renewable energy sources, according to arrangements identical to those set out in Article 5 of that directive;

As for the horizontal effects, the Commission came to the conclusion that, absent the merger, GDP would have been very likely to become the main competitor in the electricity markets in Portugal, considering (i) that having access to competitive gas resources confers a significant advantage in electricity as gas-fired power plants (CCGTs) now constitute the most common way of generating new power and (ii) that GDP, as a Portuguese company, could rely on its brand and gas customers, to which it could offer a joint supply of gas and electricity.

This Directive forms part of the framework for the internal energy market with regard to which the Commission has forwarded two proposals to the Council with a view to establishing common rules governing the internal market in electricity and natural gas (The Directive on the electricity market was adopted in December 1996.) The Directive basically takes over the principles of the Directive on electricity (i.e. access to the system, reciprocity, subsidiarity and the gradual opening-up of the market), while taking account of the specific features of the natural gas market (See Press Release of 8 December 1997 n° 13134/97 (Presse 383)).

In this context it agreed to verify that both approaches, in a spirit of reciprocity, lead to equivalent economic results and, therefore, to a directly comparable level in the opening of markets and to a directly comparable degree of access to electricity markets and that they conform to the provisions of the Treaty; 3. notes the Commission's working paper on the organization of the internal electricity market, following the request expressed by the Energy Council at its meeting on 29 November 1994; 4. confirms, in the light of this working paper, that one of the Directive's main objectives concerning the internal electricity market is to increase competition in the interests of all consumers, and that, to this end, European electricity systems must progressively take market mechanisms into account, allowing in particular for the situation of independent producers and eligible consumers, in the framework of flexible and pragmatic solutions which will: - permit the performance of public service obligations imposed on electricity undertakings in the general economic interest, including objectives set by each Member State regarding security of supply and environmental protection.
