McKenna, Special Commissioner appointed by the Governor in Council to investigate the condition of Indian affairs in British Columbia, and the Honourable Sir Richard McBride as Premier of the Province of British Columbia, an Agreement was arrived at, subject to the approval of the Governments of the Dominion and of the Province, for the purpose of settling all differences between the said Governments respecting Indian lands and Indian affairs generally in the Province of British Columbia, and for the final adjustment of all matters relating thereto by the appointment of a Royal Commission for the purpose set out in the Agreement; and whereas by orders in council subsequently made by the respective Governments of the Dominion and the Province the said Agreement was approved, subject to the further provision that, notwithstanding anything in the said Agreement contained, the acts and proceedings of the Royal Commission shall be subject to the approval of the two Governments, and that the Governments agree to consider favourably the reports, whether final or interim, of the Royal Commission, with a view to give effect as far as reasonably may be to the acts, proceedings and recommendations of the Royal Commission, and to take all such steps and proceedings as may be reasonably necessary with the object of carrying into execution the settlement provided for by the Agreement in accordance with its true intent and purpose; and whereas a Royal Commission on Indian affairs for the Province of British Columbia was duly appointed for the purpose of carrying out the said Agreement; and whereas the said Royal Commission has since reported its recommendations as to lands reserved and to be reserved for Indians in the Province of British Columbia, and otherwise for the settling of all differences between the said Governments respecting Indian lands and Indian affairs generally in the said Province: Now, therefore, His Majesty, by and with the advice and consent of the Senat ...

In order to ensure a smooth coordination between the law applicable to the succession and the law of the Member State of the appointing court, the court should appoint the person(s) who would be entitled to administer the estate under the law applicable to the succession, such as for instance the executor of the will of the deceased or the heirs themselves or, if the law applicable to the succession so requires, a third-party administrator. The courts may, however, in specific cases where their law so requires, appoint a third party as administrator even if this is not provided for in the law applicable to the succession.

Underlines that a peaceful and just settlement of the Middle East conflict is vital, and welcomes the fact that it will represent one of the most urgent priorities of the new US administration; asks the US administration to coordinate closely with the EU and engage in the Quartet; welcomes the early appointment of a US special envoy for the Middle East in the person of the former Senator George Mitchell; emphasises that both partners should strive for intensification of the negotiations based on the road map and the Annapolis Conference achievements, with the objective of a two-state solution; urges both partners to work closely together in order to help make the current fragile ceasefire in Gaza solid and durable, while involving the regional actors and contributing to the achievement of the goals of UN Security Council Resolution 1860 of 8 January 2009 (S/RES/1860(2009)), such as an immediate humanitarian relief for the population of Gaza and the assurance that illicit trafficking in arms and ammunition is prevented and the blockade of Gaza is lifted; calls on the transatlantic partners to support efforts for inter-Palestinian reconciliation, and points out the importance of improving the living conditions of Palestinians in both the West Bank and Gaza, including the reconstruction of Gaza;

Improvement of the administrative and legal environment of enterprises inter alia in the area of indirect taxation in order to alleviate the burdens on SMEs arising from Community legislation B. Better access to Community information for enterprises C. Improving the business-partner-search network D. Continued development of instruments permitting direct contact between entrepreneurs and aimed at promoting transnational subcontracting E. Ensuring full consideration of the interests of SMEs in the various Community initiatives and policies II. ENSURING THE CONTINUITY AND CONSOLIDATION OF ENTERPRISE POLICY IN ORDER TO ENCOURAGE THE EUROPEANIZATION AND INTERNATIONALIZATION OF ENTERPRISES, ESPECIALLY SMEs, A. Encouraging SMEs, including craft-industry enterprises, to adapt to structural changes and to changes brought about by the internal market, in particular through information, exchange of experiences and transnational co-operation activities B. Promoting a better financial environment for enterprises C. Promoting better observation of the economic development of enterprises as part of the dynamic of effective implementation of the internal market D. Evaluation and development of enterprise policy. In order to achieve these objectives and insofar as they cannot be better achieved by the Member States, the Commission, assisted by a Committee composed of representatives of the Member States, will implement such measures as need be taken at Community level, allowing for the findings of any evaluation reports.
